GUILTY AS CHARGED,
Jim Lotan and Seid Back
So Declared.
Are
A JURY VERDICT NOT EXPECTED.
Efforts Will Be Mado to Secure
a New Trial.
Portland, May 20. The Jury in
the conspiracy case lu which James Lo
tan and Seid Back appeared ub the prin
cipal defendants, was ready torepoit
to the court Saturday night by 11:30 p.
m. Owing, however, to the absence
from the court room of Seid Back, an
officer was dlepaohed after him that
the verdict might be read in hla pres
ence. It was about 12:30 when the
jury entered the court room and took
their seats. There was not very many
present. Dead silence reigned from
the moment the Jury entered and took
their seats. Mr. Lotan, who was pres
ent, seemed greatly absorbed and on
his face one could easily read:
"I wonder whether it is guilty, or
not guilty?" Occasionally he would
leave bis seat and engage in a conver
sation, evidently to relieve bis mind of
the strain upor it. Bomo begun to be
Impatient, but District Attornoy Mur
phy thought it necessary to have Held
Back in the court room that he might
hear the verdict of the jury in the case
in which he was involved.
It was about 1:40 Saturday morning
when Seid Back was brought into the
courtroom. The jury was then called,
each one answering as his name whs
called. The verdict was then turned
over to judge Bellinger who gave it to
tho clerk, and the latter read the fol
lowing in a clear veice:

The one great aim In tho argument
by Judge Mallory appeared to be that
of tearing to pieces the evidence given
by Nat Blum, principally by shewing
I where his testlmouy had boon con
tradicted. Counsel reierred to wit
nesses Wt L. Boise and Thomas Jor
dan, which gentlemen had emphati
cally duuleu receiving tie money aa
testliicd to by Nat Blum, who at first
said he paid it to a third party, de
clining to nlve names for fear of being
contradicted. In respect to Nut's Buy
ing that the nte writ en by Mr. Lotan
to haddock, the Inspector, wuo was
ezamlnidg Chinese on the Htytbii
Republic, was delivered by him t the
inspector, counsel reminded the court
that Paddock had tosttded that a
Chinaman delivered it to him.
"Nut told about the meeting at his
office when the conspiracy was
formed," oouiiuued the judge, "lie
snld that Chin Chine and Seid Back
were called in an hour afterward. Why
did he not state so on the former trial?
Then ho said nothing about Seid Back
and Chin Chene being at the meoling.
"But thlsls in touch with the conduct
of the case by the proseoutlon. They
want to convict Seid Back, the China
man. They have H'A tried to coviot
Lotan."
Counsel's closing lunguage was an
uueuvtublo delineation of Blum's
cburacter. "Compared with Blum,"
he said, "compared with the hideous
deformity, this indescribable monstros
ity, the deepest dyed devils of Dante's
'Inferno' are golden and glittering
ornaments of morality."
Upon the convening of court after
the noon recess Judgo Duraud com
menced the final argument for th
prosecution; Addressing himself to
the court and Jury, be said that the
caso was "a government case," upon
which the Jury eat oT till leeus of the
United Btates and not as Jurors for tbo
state, Counsel grow eloquent as he
warmed to the subject. He said such
conspiracy could not go on without
the knowlodge and couulvancoof the
customs cflloials of Pottlund; that
Lotun must huye known of It for the
reason that hu himself had teutlliid
that Nat Blum had come and told him
all about It; thut Lotan kbow from Ills
own testimony, that a Hue of xteumers
had been established for thin purpose.

Chicago, May 27. The wheat mar
ket opened exciting and higher to-day

point only k of a cent under the top
figures during the recent boom. Liver
pool was quoted li2d. higher. July
opened between 80 and 81 against
79 at close on Saturday. Options sold
at ouce to 81, dropped to 80, jumped
to 81, and broko to 70 J, then grew
firmer again. Thou with indications
that tho vlsiblo supply would only show
u decrease of about 1,600,000 bushels,
against estimates ranging from 2,000,000
to 8,500,000 Saturday, the price of July
wheat broko to 70 and finally sold off
to 781, but after posting of the visible
supply report, showing a reduction of
2,240,000 bushels, there was & rally to
78J, the market closing at 78.

A CONTEMPTIBLE WARFARE.
Tho Portland Oregonlan la conduct
ing Its usual contemptible warfare on
Harrison B. Klncaid, Secretary or
State. Ho Is a man it cannot handlo,
either as an ofllclal, n votoran editor of
a Republican paper, or as n Republican
well grounded In tho principles of the
party. Of course, ho committed the
unpardonable sin last winter of not
using his office or Ills newspaper or his
friends to help olcot a man senator
whom the pooplo of Oregon did not
want. That is enough to damn him
in the oyes of the cinch and monopoly
organ forever. To punish and disci
pline him for refusing to stand In, a
bill was introduced In the Senate by
one of tho' puppets of tho Oregonlan
that raised the salary of all tho state
officials who were getting leas than
five thousand dollars u year and cut
down tho salary of tho Secretary of
State to less than that of a sheriff of a
second olass county. But Klncaid had
friends In the legislature who saw the
Injustice of the "reform" salary bill and
sat down upon It, aud tho Oregonlan
has been lmplacablo in its hatred ever
since.
It dare not attack Klncaid editorially
because ho is more than a match for
Harvey Scott. They dare not attack
him officially because all his aota have
been strictly according to law and in
tho interest of tho people and the tax
payer. So they get up anonymous let
ters and fictitious communications to
slur and ridicule tho man they dare
uot openly attack, and over his shoul
ders strike at Senator Mitchell. To
personally attack either of those well
known citizens of Orogon would be to
make friends for them among the peo
ple, regardless of party, and few Re
publicans are such Oregonlan worship
pers as to not resent the contemptible
methods employed In this instance,

Gresham Is still a yery sick man. . Ills
condition ohangod for tho worse early
this morning. For several hour those
at his bedside were muoh alarmed. The
stomaoh trouble which caused so much ,
pain in the early stages of bis illness
returned with renewed foroe about
midnight and they did not yield to
treatment until nearly daylight, The
secretary was yery much exhausted
today aud a physician has attended
hlmoloecly. The unexpected relapse
caused muoh concern. It Is said to
night that Gresham Is muoh easier.
His attendants are not without hope
that ho will eventually recover.
