MolNTYRE, of 11-22-lt-dw Harriot & McIntyre. County Officers Indicted. Portland, Nov. 22. County Treas urer Charles A. Malarkey, Sherifl Penumbra Kelley, and Qounty Clerk T. C. Powell were indicted by the Multnomah county grandjury. The allegations agalngt Treasurer Malarkey are that, being duly qualified as the county treasurer, it, was his duty October 1, 1893, to make and file with the clerk of tho county court a report showing the amount of money he bad received during the six months preced ing, from what source the money had been received, with the date of its re ceipt and the persons from whom re ceived, the amount of money paid out by him, the warrants and the amount or money on hand at said date. This bill recites that, as Treasurer Malarkey willfully and unlawfully failed to file such a report and "is guilty of non feasance in office," contrary to the laws provided for such cases. The specifications against Penumbra Kelley aB sheriff are that it was his rtntv to file a renort showing the amouut of money he bad collected.and from what sources, and the amouut of money he had turned over to the treas urer each month. The charges against T. C. Powell, the county clerk, are substantially tbeBame as iu the cat.es of the treasurer and sheriff. There will be a very interesting ses sion of the criminal court tomorrow morning when the officials are orrlgned. When approached by newspaper re porters today the officials had "nothing to say."
