Car ter, with whoie hdlory about every liersoti In Laurence county is now thoroughly acquainted, having read the published accounts of his trial for the murder of Crockett, of Ills sentence to be hanged, of his escape and reca( ture after btflng at liberty for neatly six years, was today sentenced u second time. Ho was brought into the court room by Hlirriil Wilson at 116 o'clock today and arraigned before Circuit Judgo Iloblnsou. After reading the record of the case, and tho p.lsoner being Identi fied by Clin. Warren and Richard lienuct, the Judgo usked the prisoner as to whether he hud any reason to set forth why the sentence of death should not be passed upon him, the prisoner, in a llrm voice replying: "I have none." And then,as adeath-llkestlllness per vaded the room, the Judge proceeded to pnss sentence upon the condemned man, placing tho date of Ills execution on Friday, April 1-1, 1893, between the hours of 10 a. m. and 4 p. in. Then us tho prisoner was aguln taken back to his cell to uwalt the approach of the futol day, every eye in the densely packed court room was intently turned upon the condemned mun until his form hud parsed thu threshold, Attorneys French and Thomas, counsel for Carter, usked thut matters bo deferred until tho meeting of tho supreme court, which takes placo Feb. Street Improvement Oases Decided by Judgo Burnett. In (he city street Improvement cases, which were argued all yesterday after noon and this forenoon, Judge Uurnett this afternoon rendered his decision sustaining the demurrer to the city's answer, and dismissing the suit, decid ing the cases ngalast the city and In favor of thu abutting property owners. Tho city attorneys have twenty duys to complete their appeal to the supreme court, The apeul will probably have to order the appeal, Amos Htrong vs. City continued, It. P. Uolee made the argument for tho demurrer. Tho principle upon which Judge Bur nett rests his decision is that the char ter having made no provision for the giving of notice to the owner of property lobe assessed for the proposed improve ment, tho fuct thut notice was given does not cure the defect. The new charter contulns a clause that requires notice to be given before such an assess ment can be mado a churgo against the property. PERSONAL AND LOCAL.
