day heard argument lu the case in
volving the allegation that an option
had been given on a lot In which i
the grave of tho mother of George
Washington. Tbo title ot tbe case
is Kolbert & Klrtley vs, Sheperd,
from tbe circuit court of the city of
Fredricksburg. Tho records show
that February 29,1889, thedefendeut,
Shopeid, gave Kolbert fc Kirtley, a
real estate Arm of Fredricksburg, an
option for the purchase of a lot. The
sum mentioned was $20,500, which
was to include also a monument
which had been contributed by a
New York man, but nevei com
pleted. The real estate firm claim,
aud the recoids bear out the claim,
that they found a purchaser for $20,-
500 in G. II, Huntington, of Bulil-
more. Tho property was advertised
lu various parts of tho country, and
attracted considerable attention.
The result was that the neonle of
Fredericksburg held a mass mtetiug,
at which resolutions disapproving
tho proposed sale of tbo sacred spot
were adopted, Shepeid refust'd to
accept $20,600 aud to make a deed
for the lot. Tbo result was a dam
age suit instituted by tbe real estate
firm In tho circuit court of Fred
ericksburg. The decision is ugainst
tho plaintiffs, tho court holding that

He was m drunk at the time that
he imagined all she had to do was
to turn her hand over and the neces
sary money would be made.
