On March 31, 1903, the mayor and
common council of ..this city received a
letter from Mr. Werner Breyman and
Mrs,- M. EL Breyman - which is again
published for the information of the
readers of this paper. In their commu
nication they said: , -.
"Gentlemen: . We, the undersigned,
pioneer citizens of the "city of Salem,
Oregon, actuated: by loyalty to the
rhome- spot we- chose. manyt years ago
and have cherished for the span of
nearly .half a century; in honor of the
city . that jwe have seen' grow from "a
Village, and that has been the center of
those innnerable episodes of joys and
sorrow that go to make the sum of life;
and to mark, even by limited expres
sion, the gratitude we feel for the
honors and blessings ' that have been
wrought in .our careers by the friendly
associations -and business opportunities
that have been ours, do, now, and here,
, tender to the city of Salem, Oregon, in
perpetuity a publie drinking fountain

So great has been the demand
for pianos and organs daring our
closing out sale that we are actual
ly forced, not only to extend the
time limit of the sale, but to
appeal to our Portland store for
goods to fill our orders. We
never expected the Salem public
to respond so overwhelmingly to
our offer to sell out the Salem
stock at jobbing prices, neither
would we dream under ordinary
circumstances of ordering a piano
from the Portland store to be
sold at a cut rate. However, we
do - it now, not so much as a
matter of immediate pro
fit, as a mark of appreciation
for our late success. This has

The fountain referred to in the above
letter has. been received, and steps will
be taken immediately with a view to
placing: it on the site selected for it.

Win. Brown at the residence of Mr.
Breyman yesterday, to ; discuss plans
and to make arrangements. , ;
The fountain will be placed. on. the
east side of Cottage street, at the end
of the new walk - laid through Will
son 's avenue, and will - be set in a
curve, which will be made in the walk
leading from Court to State street.
The fountain -has not been unpacked
yet, henee it is impossible to5 give a description-of
it. This will he done as
soon as possible. The figure is of a pio
neer looking and pointing to the west,
and is in bronze. The figure will be
nineteen feet high, is six feet across
the base and weighs 5000 pounds. It
will have a trough for" animals as well
as a cup for thirsty mankind. It will
be a very attractive feature in the

Six Decisions Handed Down by the
Judges at the Morning Session
Tester day, on Appeals From "
" Various Counties.
Thesu'prerme court handed down six
decisions at noon yesterday,! none , of
which! were of great importance except
to the sections in . which they origin
ated. ': j- .
Justice Bean reversed the decision of
the lower court and ordered a new trial
for the case of W. II. Goltra, executor
of the will of Hugh Fields, f deceased,
against Jane Penland, executrix of the
will of William Penland, "in? which the
defendant received . the verdiet ana
judgment.
The plaintiff claimed Penland had in
his possession 3719 sheep belonging to
Fields,- which he was keeping on
shares, and which he afterward sold
and made no settlement with the owner,
to. bis damage in the sum of $10,306.

, A new trial was ordered in the caso.
of the Fire Association of Philadelphia
against John Ollesind, of Prtland.
The atterheld a policy against the
company fof . $2000 on a stock of um
brellas and parasols whieh were de
stroyed by fire on April 28, 1903. . The
loss was appraised at $13,562.18, and
the total amount of insurance carried
was $11,500. , ,
The company alleges that f the policy
was void because at the time it was
issued, the stock was covered by a
chattel mortgage, and they also claim
tho books were padded with figures
and with this proof the appraisers set
the loss whieh was in reality not more
than $7000.
The decision of the lower court in
awarding damages to Louis j Anderson
in his suit against the Oregon Kailroad
and Navigation Company was affirmed
by Justice Wolverton. A quantity , of
wheat owned by Anderson in ar ware
house at Cayuse, in Umatilla county,
was destroyed by fire caused by sparks
from a locomotive on tho O. B. & N.
Co.'s tracks,." The court held that the
engine was overloaded and proper pre
caution had not been taken to prevent
the spread of sparks and cinders.
Justice Wolverton affirmed the decis
ion of the lower court in the claim of
T. . W.- Thompson against U.s F. Purdy,
of Washington county, associated in
business as the Gaston Co-operative
Milling Company. The company bor
rowed $4000 and the plaintiff Was
compelled to pay off' the notes, and
sued defendant for his portion, and
judgment was rendered for ' plaintiff.
The defendant claimed he advanced an
equal amount of money by agreement,
for repairs. The sole issue' at the trial
was the answer. ,

' Hattie Jones was refused a divorce
from William Jones, of Pendleton,, by
Chief Justice Moore, and, the lower
court -was affirmed. The testimony
showed : :. both principals equally , to
blame . for the '' quarrels ' and ; evenly
matched in encounters.
The ease of John A. Wood, et ox,
against Kichard M. Fisk, et aL, from
Wallowa county, which was decided in
favor of the defendant in the lower
court, was reversed by J ustice Bean,
and; remanded for a. new trial. The
suit was for the possession of real
property and for damages, f

guay Government has received infor
mation that a victory over the insur
gents has been won by Colonel CSalarza,
in command of the Government troops
at Cereco Largo, six hundred insurgents
were killed or wounded.
