Peterison, appeiiamt; appeal from Marion county, Hon. Geo.H. Iiur nev. Judge; ;i affirmed; opinion by Aseociate Justice F. A. Moore. This wa,s an action for damages for obstructing "af afleged highway. The plaintiff avers that he has, sinte May lz'Jli been fn ioaKession of certain real ektate from which he has been In thej hjilit to pa, with vehicles and n foot along a duly dedicated high way fo the county court; that such highway "is the only accessible route to and from his premises and that de fendant wrongfully - -obstructed the same by placing a rence across u, u plain-tifTs d!amageln the sum of S1M0. The arwsiver denied the material alle gations, and Ihe trial resulted' in a verdidt for the plaintiff for t $100, and defendant appealed. Defendant ron-tf-rtdr4i 'that' the court erred In admit ting in evidence, over objection, the recordWl plat of the Waldo Hills Fruit Farm, showing the land subdivided in tracts, to be , cut up with roads, I:: ill tijut by the original owners of the land, janl, in the dedication these roadsjare dvfdgnaad as sucht to as sure ihe purchasers of the. lands the dencej jln-case, and that they are roada. The appellate court holds that the recorded plat or mitp. so designating thsej roa-le, . was admlasable " as evi- doitoe in. the case, and that the ro.is. ! even jthough the county had perform ed n work, on them, hence there was n f-rror in admitting this testimony. The plaintiff having filed a cost bill. trie ftt;m, among others, of ."To sher iff's fVets 3." -was objected to, but al- Tovveft by the court, and this: was as signed as error. It is found ( ihe sheriff 'traveled 30 miles in serving the summons, and the apellate . court find; he w'a3 entitled to-10 cents a rnile traveled, under 'the1 laws of Ore- Ktin, 1M9. p. 66.
