the Senate at 2'o'clock today, the Chi
nese Exdueico WH, 1 known as the
Mitchell -Kahn measure, was called np
as unfinished business, and considera
tion of it began. Hon. John H. Mitch
ell, United States; Senator from Ore
gon, made the opening speech. ' ' His
address had been carefully prepared
and was given the closest attention by
the Senators and the galleries. :
'Senator Mitchell, in beginning', said
that the policy of the Chinese exclus
ion had become one of the great policies
of this country, acquiesced In by alt
political parties and as firmly fixed as
the Monroe doctrine. It la a policy
based upon the general welfare, upon
the principle of protection against nox
ious infection of the institution which
constitutes American civilisation. The.
basio principles ' of the pending1 bill
were embodied in xistin- legislation,
end such additions as have been pro
posed were approved , by experience
t-.nd were in accord with the decisions
of the courts.
The f ranters of the measure had en
deavored to make it as. effective as
possible as a. restrictive measure, while
keeping- steadily in view all necessary
menas of protection against fraud. An
effort has been made to liberalize these
provisions refuting - to the exempted
classes. No radical departure was pro
posed from the statutes now ia opera
tion, the bill being a -irtual codifica
tlon of tfie ex'ntlng laws and regula
tions concerning the admission to this
country of Chinese persons. The aim
of the framers was" cnrefully to avoid
anything which might- give -just cause
for offense to the Chinese empire, nd
to an extent, aX ' least, 4t was a more
liberal measure, so far a the exempted
tl&sses were concerned, than that
which 1a n'w on the statute books.
Senator Mitchell then entered on an
ext,cndc-d analysis of JLhe proposed
measure, making his explanation of Ms
provisions in the fi-ghl of the decisionj
of the hlg'hest .courts relating to Chi
nese exclusion which i have been deliv
ered since the enactment of the Geary
act. The theory on whch the meas
ure was constructed, he said. Is not
that all Chinese pe,vhs who are not
prohibited may enter this country; but
upon the contrary, the legislation pro
ceeds Upon the theory that "only those
are allowed to'enter who are especially
allowed." Therefore.every Chinese
person shall' be deemed a laborer,
wtthln the meaning of the bill, who Is
not an official, a. teacher, a studeht, a
merchant or a traveler for pleasure;
Referring to the regulations, in the
measure for the prevention of fraud,
Mr. M'tchell said that no one could
successfully question the 'authority of
tTongress to establish and enforce" all
necessary rules which wfuld operate
em statutory safeguards against fraud,
and which would test properly the good
faith of. Chinefce personsN:laiming- to
belong to one or another of thexP
ed classes. He held that, this Govern
ment never would barter away Us in
alienable light to prohibit th coming
to this country of any class of people
from any country on earth, if In the

Mr. Mitchell expressed the ' belief
that the constitutionality of the pro
poeed measure could not be challenged
successfully.

ex lifting treaty stipulations between the
United States and China. Even if It
were this could be urged only as a po

in line with public sentiment of this
country, but also with the established
policy of this Government."
