The respondent In. the luit sought
to have a tax decreed 4o tx void, and
that It be removed as a clot d upon his
title. The lands described : n the deed
wer sold by the sheriff f Marion
county for taxes, to J. K. arlay, who
in turn transferred his certificate to
the appellant herein' Later the sheriff
made a tax deed to the ap pellant, but
neglected . to place theieon his prtva-t
seal, and was compelled a short time
thereafter to make a confirm -ttory deed.
On March 27, 1900, the court set aside
the deed, and defendant appealed.

Following is a statement of he case:
This wss a suit to foreclose mort
gage upon certain lands in , Douglas
county. ' The mortgage wan given by
George W. Riddle. Helen G. Riddle and
William H. Riddle (since deceased), to
secure a certain bond or - promissory
note of George W. and Helen G. Riddle
for the sum of $11,000, pay i ble on the
first day of . May, 1893, and len certain
interest Coupon notes, pay hie semi
annually. The. principal no e bore In
terest at per cent, with u'.provlslon
for 8 per cent after maturity. The
complaint, after setting oui the prln

sum -of $9,500 with ' interest, -thereon
from7June 1, 1897, at f pT cent per
