CHANGING A WILL
IN THECOUNTYCOURT

‘‘Since we’ve got a new car
and just bought a house, I sup
pose we ought to look at our
will to see if any changes need
to be made,” Fred said to his
wife.
“Good idea, I’ll get the will
out of the file box and we can
change what’s necessary right
now. This is a bad night for
TV anyway,” she replied.
“Wait a minute,” Fred cau
tioned. “We can’t change the
will that way. We’ll have to take
it to our attorney to make any
legal changes.”
“What for? The will is signed
and witnessed. We can make the
changes in ink right on the will,
„initial the changes and that wili
be O.K., won’t it?” Fred’s wife
asked.
‘‘Not according to the law.
We’ve got to make a codicil,
the only legal way to change a
will or write a new one. Let’s
not ask for more trouble than
we’ve already got,” Fred
replied.
Fred is correct, of course.
Only a codicil, a specific legal
document, can legally alter a
will. It must be drafted and
signed in the same manner as
the will. Two witnesses are re
quired, just as with a will.
Corrections made to the ori
ginal will, such as striking out
a word or phrase, could make
the entire will void. Even in
itialing the changes does not
make them legal.
If the changes are complex,
codicil may not be the best
answer. An entirely new will
might have to be drafted.
However, if the codicil is
determined to be the best
answer, then it should be
attached to the will so that the
heirs will know of the changes.
When your will was drafted,
it took into account numerous
factors that would relieve your
family of financial and legal
problems which could come if
you had no will. Don’t ruin
all this planning by making
illegal changes.

person should apply or inter

an attorney who is completely
advised of the facts involved.
Even a slight variance in fact
may change the application of
the law.)

Exports Reach
All-Time High
Grain exported from the
Ports of Portland and Astoria
reached an all-time high during
the fiscal year ending June 30,
1968.
Records of the grain division
of the Oregon Department of
Agriculture show 3,250,989tons
of grain weighed and inspected
for export. This was 417,278
tons more than the previous
fiscal year.
Incoming grain, which totaled
3,599,478 tons, also exceeded
the amount inspected the pre
vious fiscal year, when the total
was 3,166,276 tons.
Totals for the fiscal year
just ended also showed the
department inspected and
weighed 78,693 tons of grain
on rail cars at Pendleton;
inspected 287,034 tons of grain
for diversion at Pendleton;
inspected 103,304 tons of grain
for diversion at Merrill; issued
a total of 174,171 certificates,
with 157,606 of these in Port
land; and made 34,907 analyses
