We extend the sympathy of the com munity to the family of the late Eva McGee. She was much es teemed and a great help in sick ness in the years gone by when she was able. She had lived here many years. Some over a year ago she, with her husband, sold their little home and dairy on the Burn and moved to Vernonia. Al though a great sufferer for sev eral years, she was always cheer ful and had a pleasant word for all whom she came in contact with. The writer has known and been a neighbor of her’s for ov er 30 years and has yet to hear her make an unkind remark about anyone, always looking to the bright side and making the most of whatever came her way. We shall miss her when the shades of night deepen, Many of the all-time record number of tourists and vacationists who are planning to take to the open road this year are expected to include Oregon's pic turesque coast line in their Itinerary. This picture of Heceta Head is one of a series of fifty-four full-color Public io Get Scenic Views The 1947 edition of Standard of California’s famous “Scenic View” travel promotion program will get under way next Monday, May 26, when the oil company and its subsidiaries begin free distribution of 27,000,000,000 full color “See Your West” photo graphs. This year a total of fifty-four views of top tourist attractions in fifteen Western states, British Columbia, Hawaii and Alaska will be given away at the companies’ retail outlets. The photographs are 9 by 12 inches and are printed on 12 by 15-inch mats. On the back of each mat is a commentai y on the scene written by a well-known author. The oil company plans to give away 27,000,000 copies of the photographs through its various retail outlets. more than 6,000 natural color photographs submitted by pro fessional and amateur cameramen all over the country. Distribution will be made on a regional basis with fifteen differ ent views available in each of seven areas in the West. By traveling- into the other distribut ing areas or by correspondence with other collectors in these areas, the public can obtain the entire set of fifty-four pictures. Within each’ area the fifteen views offered will be distributed in weekly rotation in a number of different zones. Thus, if pictures are missed at one point, or if dup licates are wanted, they can be picked up in an adjoining zone. Said last mentioned section provides briefly that whenever the county court shall find that county high ways are being damaged by reason of being subjected to any partic ular kind of traffic, or that it would be for the best interest of the county and for the protection from undue damages to said high way, to reduce weights and speed of vehicles moving over same, or to close such highways or sections thereof for any or all traffio or for any particular class of traffic. LYNCH AUTO PARTS RIVERVIEW Phone 773 or commodity for such periods of time as in the judgement of the county court will be for the best interests of the county, providing that the authority herein granted shall not authorize closing of any road to the movement thereover of products of the soil by persons having no other road upon which to travel, but hauling of such pro ducts shall be subject to rules and regulations of the county court. The county court is further author ized “to make and include in such order, any rule or regulation not inconsistent with the foregoing provisions and authority for the preservation and protection of any public highway or section thereof.” The section then imposes a fine for violation of the order and re- quires the posting of notices on the roads affected. “The principal argument made by counsel for petitioners is direct ed against the provision of the order applying to permits and bonds in connection with such per mits, it being argued that they are urreisonable burdens upon the operation of petitioners. Clearly, they cannot be as burdensome as would be an order unqualifiedly closing the county roads during any designated periods for all heavy hauling, and it is plain that the language of the statute would authorize such action by the coun ty court if in the discretion of the court it were deemed necessary to protect the roads from unneces sary damage. Since therefore, the provisions of the order authorizing operations under a special permit and bond guaranteeing the county against loss by unnecessary dam age to the roads is less burden some than would be the complete closing of said roads to such op eration, it is impossible for this court to say that the provisions in question are unreasonable burdensome, It is further argued that there is no authorization in the statute for the county to re quire a permit and the posting of a bond. While there is no specific author ization for the requirements of the bond, such requirements is precisely the same as that author ized in the preceding code section 115-393, in connection'with permits which may be granted by the county court for the hauling of loads not authorized by statute. The purpose of the bond is ex actly the same in each instance and if the bond requirement is to be deemed a reasonable one in the preceding section, it must be as sumed that the legislature intend ed such a requirement to be a regulation not inconsistent with the authority for preservation and protection of highways covered by Section 115-394 which is the sec tion under our immediate con sideration. “It is therefore my opinion that the petition should be dismissed and the action of the county court sustained and approved.
