Since Mr. Richardson gave his testi mony on Monuay and Tuesday, experts have been kept on the stand up to tnis writing. A considerable part of the expert testimony has quite apparently lief n in favor of the citizens. One of the experts, Major Bowlby, state highway engineer, was on the stand Wednesday and gave testimony which seemed to favor the Warren Construc tion Company. Under cross exami nation today, by the citizen's attorney Senator Fulton, however, he gave tes timony that seemed to strengthen the citizens' case very much. He is on the stand at this writing. He states, in substance, that so far as he can see by ocular observation the wearing surface of our pavement is a bituminous con crete, and admits that if it is composed of from 37 to 90 per cent sand and the rest of bitumen, that it is an asphalt topping. Now, it is of common know ledge as verified by the tarious analy sis that have been made that the top dressing of our pavement which varies in thickness of from one half to an inch or more in thickness, is composed of from 87 to 90 per cent sand or min eral agrega'e of the appearance of sand, nd the remainder bitumen Therefore, according to Major Bowlby's testimony and the analysis of the chemists it appears that we have an asphalt pavement. However, the specifications call for a bitulithic pave ment and the people are expected to pay for a bitulithic pavement. J'he evidence io far given eums to bear cut the contention of the citizens to the effect that our soil is not adapt-, ed for the laying of bitulithic pave-1 ment. This is in accoidanre with the recommendations of bngireer Richard son which recemmendation is on file with the recorder. Tne trial promises to be a lengthy one. As was to be expected, the Head light devotes considerable space in its i last issue to unwarranted criticisms of ' our citizens who are fighting the War-1 ren Construction Co. From appear- j ances, we should judge that the Head-1 light's aim is to put those who are ' standing the brunt of the fight in a I questionable light before the people, i and discourage the citizens in every way possible in their present conflict, j Why does not Mr. Baker leave the matter to the courts, where It must eventually be settled and not bcek by every hook and crook ai d dirty method imaginable to stir up hatred among our people. From the very beginning of the paving controversy he has been foremost in throwing out slanderous insinuations and is probably far more responsiole than any one person ori set of persons for ihe hard feelings which now prevail.
