Section 41. Penalties for Violations.
Any person who violates any of the
provisions of this art or who fails to
provide himself with the proper limit,
license or licenses prescribed herein,
shall, upon conviction thereof, or up­
on entering a plea of guilty to a com­
plaint or indictment chargng him
with the violation of any of the pro­
visions if this art. unless otherwise
provided in this act, be punshed by
a fine of not to exceed four hundred
dollars ($400). or by mprisonment in
the county jail not to exceed one
year, ar both such fine and imprison­
ment. in the discretion of the court.
The court before whom such convic­
tion may be had. may also, in its
discretion, and as a part of the pun­
ishment for violation of this act, sus­
pend, for a period not to exceed one
year, thv license or permit of the
person so convicted.
Justices of
peace and district judges are hereby
given concurrent jurisdiction with cir­
cuit courts U try anc dispose uf vio­
lations of the provisions of this act.
Local magistrates, within their re­
spective jurisdictions, are also hereby
given the power to permanently re­
voke any license referred U. herein
upon conviction of the licensee of a
violation of any ordnance having for
its purpose the regulations of traffic
or the operation of motor vehicles,
when such ordinance is not inconsis­
tent with the provisions of this act
Section 42. Disposition of lines.—
All fines and penalties collected under
the provisions of this art for viola­
tions thereof shall be paid by the
court or judicial officer collecting the
aam* to the city treasurer of any in­
corporated city or town, if such con­
viction be had in the police court, and
to the county treasurer of the county, I
if such conviction be had in a justice,'
district or state court, and shall be,
by the city or county treasurer re­
ceiving such fine, credited to the road
fund of the county or street fund of
the city, as th* case may be; provided,
that whenever such fines or penalties
result from prosecutions initiated by
or from arrest« or complaints made
by any state traffic officer, deputy ■
inspector, member of the state high­
way commission, or by any deputy or
assistant or employe of th* state
highway commission appointed by
said commission under th* provisions
of section 4432. Oregon Lews as
amended by c hapter 9, General Laws
of Oregon, 1921, then in any such (
