Circuit Court Adjourns.
Judge Holmes convened Court on
Monday. The first case to come up
for consideration was the case State
ys. Currey. Defendant was indicted
on the charge of securing money under
false pretenses. However as the dis­
trict attorney failed to to have evi­
dence and was not ready for trial and
did not show due diligence, the case
was dismissed.
In the case of A. Ramsey and Tilla­
mook County Bank vs. Milwaukee
Mechanics Insurance Co., a directed
verdict against defendant was given in
favor of the Tillamook County Bank
for 31500 and interest under mortgagee
clause in the policy, representing a
loan by bank to Ramsey of $1500. Court
directed verdiet in favor ¡of defendant
against A. Ramsey for costs. Under
the proof the policy was rendered void
by act of Ramsey procuring subsequent
insurance without consent of the de­
fendant indorsed on policy or written
into it, but such act did not render it
void as to the Tillamook County Bank
under the statutes of Oregon and the
evidence adduced and the terms of the
p ilicy.
In the case of A. L. Steiner vs. O.
A. Jackson, action for damages for
breach of contract of sale of Holstein
dairy cows, verdict was returned in
favor of plaintiff Steiner for $458 and
costs, order of sale of attached prop-
erty.
Case of Hefti vs. V. Jacob was dis­
missed by agreement of parties with­
out cost.
All Jury cases have been disposed of
for this term of court and Jurymen
with the exceptance of Dr. Monk and
Henry Rogers were dismissed.
Some equity cases which are on the
docket will be taken ur in June. In the
meantime Judge Holmes will preside
at an adjourned term of court at Mc­
Minnville, beginning about May 6th.

lamook county, on or before the 8th

o’clock a.m. Said wood to be eith­
