The Oregonian.
A fair sample of the way in which
technicality plays battledore and shut­
tlecock with justice in the courts of Ore­
gon, is shown in the notorious Abe
Hembree case. As long ago as Decem­
ber 28, 1905. this man, Hembree, was
arrested in Tillamook County, charged
with the murder of his wile and da ugh
ter. the latter 18 years old, and of the
attempt to conceal the crime by burning
the bodies in the shack which was their
home and in which the murder was corn*
milted. The case had many revolting
featuies The poverty of the family was
extreme, and a cause for the murder
that was not brought out in evidence
was darkly hinted. The man was duly
indicted for murder of tne daughter
and the case was brought to trial in
Tillamook, resulting in a verdict ol man­
slaughter. Hembiee was committed to
the penitentiary, where he served one
year of an indeterminate sentence. He
was
paroled last year bv Governor
Chamberlin and released. Soon after­
ward, however, he was rearrested, this
tune on a charge of murdering his wife
fried this time in Dallas, Polk County,
on change of venue, he was convicted of
murder in the first degree and sentenced
to be executed as provided by law.
Again technicality has come to his
rescue and the case has been remanded
for yet another trial. In the interval
covered between the death of these two
women and the latest action of the Su­
preme Court, llembree has either been
grossly wronged by the continual stress
which he has been under, or justice has
been grossly violated in that he has
gone all these years unhanged.
There has been absolutely no ground,
either in justice or expendiency, for the
way in which the case has been handled.
11 would make of the courts, including
the Supreme Court of the state, a laugh­
ing stock, except that the spectacle pre-
seated in dealing with it has been too
humiliating to proyoke or permit de­
rision. It has involved large expenses
to the taxpayers of Tillamook County,
many of whom, at least, are constrained
by well-known facts to believe the man
guilty.
If this man killed his wife and daugh­
ter as charged, it was murder most
foul. Parole I Think of the glaring in­

allow a man convicted on so grave a
charge and under sentence for man
