merit and litigation, trying to enforce the local option law, and we
see what a travesity of Justice the whole State has witnessed, and
being a warm friend of the local option law until it can be suc
ceeded by Prohibition, I desire to jot down for the consideration ol
the voters of the County some of the leasens that has led upto
this condition of things. There can be no doubt of the guilt of
the parties recently haled before the court for the violation of the
Local Option Law, as in every case 1 understand the liquor had,
by the parties accused, was produced in court, which in itself
would be infallible proof of the violation of the law. Iti order
that any law may be enforced, it must be sustained by its friends
and not by its enemies. To illustrate, Mr. Bryan, late Demo
cratic Candidate for President, in a talk he gave to the people of
Ashland some years ago, said, “ Men vote according as their
interests may dictate. You will soon have an election to deter
mine whether cows shall be allowed to run at large. Some will
vote that they be allowed to run at large and others will vote
that they be not allowed to ruu at large, and if you will in
vestgate you will find that the man that votes that the cow be not
allowed to run at large, has nocow.” Thus men are swayed, one
way or the other, by their respective interests. The writer
foresaw the present condition before the last election and went so
for as to mention it to some of the voters of this county. The
county officers are censured for the non-enforcement of the law,
when, as a matter of fact, it is not their fault, at least not mure
than indirectly.
The object of this article is to show clearly where the
resposibility of law enforcement rests with justice courts, and 1
wish to beg pardon from those that do know so as those that do
not know may understand. When the justice of the peace
organizes his court, the first thing in order after his qualification
is to request two taxpayers of his district to assist him in making
up his jury list anywhere from 27 to 50 taxpayers. They have
the power to approve or reject any name that may be presented to
serve as juror in his court for the year. Now as relating to
above, if for instance they are in favor of the enforcement of the
local option law they will select, as far as may be, men to serve as
jurors who are known to be friendly to the local option law and
if they be not friendly to the local option law they will select
men, a number of whom are unfriendly to the law. This is not
saying that the men thus selected either pro or con are unworthy
men, but they look at the matter from different standpoints and
a e governed by their supposed iuterests of point of view. To
illustrate again. It has been said “ that in years gone by when
Knight-hood was in flower, that two Knights traveling in the
same direction in separate roads came near the juuction of the
roads and stopped opposite a shield that was planted in the forks
of the road. Soon one of them begun to discuss the silver shield,
the other corrected him at once by saying, “it is not a silver
shield, but a golden shield,” aud thus a dispute arose which
resulted in blows, and when one was vanquished by the superior
strength and skill of the other, they then examined the shield
and behold, both were right, for in truth, one side of the shield
was silver and the other gold. And so we find that many grave
and great questions are determined by the point from which men
view them. So to make a long story short, if you want any
law enforced you place the names of friends aud not enemies
on your jury panel and your officers will no longer be handi
capped and the law will be enforced aud justice be vindicated.
The sheriff has done his duty manfully. The Prosecuting
Attorney has given his best effort and attention, but all this
will not avail so long as men are selected to serve as jurors
that are opposed to the local option law. There are many men
in the community that take a glass of liquor occasionally with
whom the local option law would be safe, as they believe in it
and would enforce it religiously had they an opportunity, but
those that have no cow are iu the saddle. And now before you
condemn the law, give its friends the responsibility of enforcing
it and conviction will follow and the lawless element will be
weeded out and the boys aud gills, the young men and young
women of this city, will thereby have au inspiration for a cleaner
and better life. In the South land where Local Option prevails,
the dumb brutes would thauk God, if they could, for Local
Option. Their drunken drivers treated them with cruelty and
neglect. Under the law their drivers are sober and good
treatment by them is manifest on every hand.
