Damages for Alleged
Negligence.
A suit was filed in the circuit court on
Friday by J. 8. Stephens against Dr. T*
W. Ross. who is wanting to be compen­
sated to the amount of $5350 for alleged
negligence in attending to plaintifTs in­
juries, who was thrown Out of a rig in
the mountains and received serious in­
juries Jan , 1907, and Dr. R om was
called to attend to the injuries.
In his complaint plaintiff alleges that
on the 1st January he sustained serious
injuries to his right shoulder, by having
his shoulder severely wrenched and the
muscles and ligaments seyerely sprained
and the bones injured and his shoulder
dislocated and thrown out of place. He
engaged defendant to attend to his in
juries, and alleges that the doctor care­
lessly and negligently and in a grossly
negligent and unskillful manner over
looked the dislocation of the shoulder,
and failed to discover the same and failed
to set the bones of the shoulder in their
proper place, and for a great length of
timeafeer the injuries and the commence
ment of the treatment, for a period of
about 39 days thereafter, defendant pre-
scribed for the injury while the bones of
plaintiff's shoulder were still dislocated
and out of place, to be treated by swing­
ing his arm, applying liniment and other
applications to the shoulder and injury,
vigorously rubbing the same, and by
massage and other similar treatments,
all of which greatly aggravated the in-
jury, resulting in the stiffening of the
shoulder and causing the same to be and
remain permanently out of place, stiff
and painful, and rendering the right arm
and the hand thereof almost useless and
causing the injury to become permanent.
That by reason of which plaintiff was
and is greatly injured in his health and
constitution, and has suffered and does
now suffer great pain and was greatly
weakened in body, for which plaintiff
wants $5,000 damages. He also claims
that he was in the insurance business
and earned about $100 pet month, and
that, by reason of defendant's alleged
negligence plaintiff was unable to use his
arm in carrying on his business in any
manner whatever for a period of morn

recovered under careful and skillful treat­
ment, thereby sustaining special dams,
