The anniversary «>t the Independent
Order ot Oddfellows was fittingly obser.
ved in this city on Friday, and in which
the Rebekahs took part, also delegations
from the other Oddfellow and Rebekah
lodges in this county, At noon a ban­
quet was served to a big crowd, after
which a procession was formed of the
two orders, and headed by the brass
band, inarched through the business
streets to the jpera house, where appro,
priate addresses were made by Rev. A.E.
Wingert, Mayor H. T. Botts, fudge W.
Galloway and Claude Thayer which was
interspersed with band music, vocal
solos by Miss Hazel McNair and Mr. T.
Coates and a recitation by Miss Lu tic
Kunze. In the evening there was a big
crowd at the dance given at the opera
hou^e, and, altogether, the anniversary
w as a success.
Justice Eakin reversed the judgment of
Judge George H. Burnett, holding
that he committed error in sustaining a
demurrer in the case about Tillamook
county, appellant, against the Wilson
River Road company, respondent. The
court holds that the relief sought for is
forfeiture of the lease ; in other words,
to cancel the instrument by which de­
fendant holds title so that plaintiff may
lie restored to its title and possession,
and that this belongs exclusively to
equitable remedial jurisdiction. The
suit was to annual a lease of the Wilson
River toll road, extending from Gales
Creek, Washington county, to some six
miles from Tillamook City, between
Tillamook county and the road compa­
ny. The lease was entered into in 1901
for a period of 50 years, providing that
the company repair and maintain it and
that defendant hold plaintiff harmless
from liability by reason of accident.
Plaintiff alleged that the county court
had not properly advertised for bids in
the leasing of the road and that the same
isunsateand dangerous to public travel.

der and Joe Wilson be appointed

road, upon the petition of Wm. Arm­
strong, alter a thorough investigation
the county court finds that there was
surveyed and located a road over practi­
cally the same route as petitioned for by
Mr. Armstrong and others in the year
1891, which survey was accepted and
declared a public road And the same has
not been vacated. Also in the year 1902,
a trail was surveyed and located over
the same route. In visw of the above
(acts, the petition was rejected as the
route is already surveyed and located.
The court ordered the road opened and
improved from lower town to the fool of
Necarney mountain and the proper pro­
portion of money in District No. 1 be ex­
pended on that portion ol the road.
The court ordered bids to be called for
the construction of two miles of road
known as the Bealscontinuatron of the
Coal Creek read.

The report of the viewers in the mat-
ter of the petition of R. O. Richards be­
ing unfavorable,the petition was rejected.
In the matter of the petition of Peter
jenk, petitioner appeared and asked that
petition be not allowed, the same being
rejected.
Herman Farmer resigned as supervisor
ol R. D. No. 5 and James Christensen
was appointed to fill the vacancy.
In the matter <4 the petition of H. IL
Brooten for cjunty road, the same was
rejected on account of a wrong date.
In the matter of the petition of Lester
Landingham for county road, F. L.
Sappington, W. W. Conder and Joe
Wilson were appointed viewers.
In the matter of the petition of H. V.
All^y for a county road, it was ordered
that the said road be opened.
The clerk was ordered to draw a war­
rant for $27 61 in favor ni C. C. Gridley
for the re-payment ol taxes lor the year
1890.
Bill <»f C. A. Patzlaf, amounting to
$12.80 for supplies furnished Mrs. Os­
burn was allowed in the sum of $6 40,
and $6.40 disallowed.
