Galloway, Mayor Botts and Claude Thayer, and in the evening there will be a dance at the opera house. CIRCUIT COURT DOINGS Verdict for #750 for Mrs. Roenicke —The Alleged Libel Sait. Judge W. Galloway is si ill presiding at the April term of the Circuit Court and the jury is still held in this city to try cases, but will, no doubt, lie discharged in a day or so, as only one or two jury cases leniain on the docket. The Roe- nicke case occupied three and a half days and the alleged libel suit against the editor of the Headlight one day. To­ day (Thursday) a jury is trying the Ryan vs. Watson libel suit. Cases which have been disposed of and still on I he docket we give below : Anna Roenicke vs Charles P. Nelson and Charles Ray. R. R. Duniway and Carl Haberlnch for plaintiff. Damages. Talmage and Johnson for defendants. This was the case in which Mrs. Roe­ nicke claimed $10,(100 for damages for injuries received caused by the telephone line belonging to the defendants being down, which caused a runaway, in which Mrs. Roenicke was thrown out of her buggy and received bodily injuries ol a permanent nature. This case was tried at the last term of the circuit court and the jury was unable to agree as to the amount that should be paid Mrs Roenicke, so the case came up for trial again at this term of the circuit court. The case was carefully fought bv the attorneys on both sides and the jury brought in a verdict for the plaintiff lot $750. B. J Stephens vs Tillamook City, a Municipal Corporation. This was a case where the plaintiff fenced up the road in front of his pro­ perty because the city wou'd not pay him for the Innd, which was torn down by the authorities For this damage Stephens claimed $500 compensation. A legal point was raised ns to its being used for a street for a number of years. Thejurv brought in a verdict for the plaintiff for $1.00. The defendant has moved for a new trial and the case may go to the supreme court. Sim Earl vs Fred C Baker. Libel. Talmage & Johnson for plaintiff. H T Botts for defendants. This was an alleged libel suit brought by Sim Earl against the defendant, who is the editor of the Tillamook Headlight, who made a mistake in printing the name of " Sim Earl'' in the place ot the name of " Jesse Earl.” The defendant corrected the mistake in a subsequent issue and apologised to the plaintiff. When the case came to trial on Wednesday the defendant's council took the position that the cause of action did not con­ stitute a libel, which was over ruled by Judge Galloway. The plaintiff went on the stand and did not testify that he had been damaged in any manner what­ ever, and the defendant having testified that it was simply a mistake he had committed, the judge instructed the jury to bring in a verdict for the plain tiff with nominal damages, which it did, placing the damages at $1.00. Xs the defendant had offered to allow the plaintiff to take judgment against him for $2.50 damages, which was refused, the cost of the case will fall upon Earl, amounting to probably over $25. P.
