set on fire, but as this endangered a barn
close by with about twelve tons of hay
in it, several parties went across the
river to keep the are under control and
protect the barn from catching fire. As
they were doing this it was noticed that
the roof of Trask house was on fire, so
they hurried across the river to lend what
assistance they could. Mr. Smith got
on the roof with buckets of water, but
the fire had obtained a good hold under
the roof, where it is supposed it origi
naled from the flue, that the water had
only the effect of increasing the fire. The
bouse burned rapidly, which did not al­
low of hardly any time to remove the
contents.
One visitor was in his
room resting when the alarm was given,
when he made his exit, and as he did so
the fire swept through the boose. A
few seconds alter that the house was a
mass of fire. Some tew things, however,
which were near were saved, but most
ol the household furniture, including the
contents of the post office and telephone
were destroyed. The barn across the
river then caught fire and burned up
The barns near the house were saved,
although it took some effort to do so.
The placed belonged to Mr. C. H. Smith,
who carried an insurance of only $600.
The loss will foot up $2,500. Mr. Smith
was in the city 011 Tuesday making pre­
parations to rebuild.
The Timber Claims Contest.
The Oregonian gave a synopsis of the
evidence in the timber claims contest on
government lands in Tillamook county i !
on Tuesday, which it says is “one of the
most notable contests that hasever been
before the land office at Oregon City.” j
It will be remembered that after the land
had been filed on by a number oi people
from Tillamook, the Northern Pacific (
tried to get possession of it by offering I
iorest reserve scrip tor the land. Tins I
application was rejected by the local and
also the general land offices. This was
the first victory for lhe citizens who were
exercising their rights, alter being called
aliens, Irauds, etc., by the railroad com-
pany. Then B. E. Watkins tiled a pro­
test against 14 entries of the batch, and
later Charles E. Hays instituted a con-
test against 73 of the applicants. After
this Hays contested the 14 claims, the
hearing oi which was completed last
month and a decision is expected about
the 24th of this month. The 14 timber
applicants included in this bunch were
Egbert D., Joseph, Frank, Lydia F., Etta
and Sopnie Severance, Flora M Means,
James R. Hanis, John E. I little, Horace
E. Weston, Frank B Harrington and
Walter J. and Alice Smith.
The decision in these cases is awaited
with a good deal of interest in Tillamook
county, lor it will demonstrate whether
a number of citizens, having exercised
their rights to tile on timber claims, and
strictly complying with the law in every
particular, without the least thought of
fraud or collusion in their transactions,
can be deprived of their rights by those
who are known to be timber irauds, but
are trying to remove the mantle of fraud
from themselves and place it upon these
applicants, who lielong to the best class
01 citizens in Fillamook county. This is
virtually the point at issue and which is
to be decided in these 14 contests. It is
not surprising that the contestant has
introduced a lot of irreleviant evidence to
prejudice these cases, with that of those
who have turned traitorB and become
the tools in the hands of those who have
instituted these contests—perhaps ior
personal spite and other considerations.
But apart from this evidence given
soinew Imt fully in the Oregonian, is that
of the mtn men themselves, which places
quite a diflerent complexion on the case
mid shows most conclusively that these
14 entrymen have in no wise circum­
vented lhe law and fraudulently com­
bined and confederated to violate it.
They are too straight forward in their
dealings to do that, riierefore, for tliesa
lensons. it is well not to be too hasty in
drawing conclusions from only part of
the evidence and forming wrong opin­
ions, and thereby dubbing these parlies
ns irauds. Iliey base only done what
thousands of other citizens have done in
complying with the law in filing on tim­
ber claims, and to deprive them of their
rights lecunse other parties failed in
their rffoi ts t«» gobble up every thirg in
sight with scrip, or oust them in other
ways, would, we believe, be unjust.
Every person who take* up timlxr land
does so for speculation. They cither
manufacture the timlier themselves, log
it. hold the timber as an investment or
dispose o| it to the highest bidder at the
first opportunity. There is nothing
wrong about this after they have come
into possession of the land and paid the
government the stipulated price. It’s
theirs, ami no one has a right to interfere
in how < r what way they shall do with
it. We make this prediction, that the
entry men in these cases will w in and it
will be decided in their favor. As. no
doubt, the other 73 cases will be also.
It is not characterized a fraud w hen big
railroad corporations gobble up large
intended for citizens, but when a tract
of land is thrown open and a number of
individual citizens make a bee line for
the land office and file ahead of these
land sharks, then a cry of “ Fraud,
fraud !•’ is set up by these corporations
to gain their ends. If these 14 cases are
frauds, then all those who have pre­
viously taken up
individual timber
claims are frauds also, and to deprive
them of it would be to deprive them of
their legal rights.
BEAVER.
Beaver is located 17 miles south of
Tillamook, and in the center of one, if
not, the richest and most productive
valleys in the world. It surely is among
the richest. Just a small village with
four cheese factories.
Mr. D. T. Edmunds, of Tillamook, has
just put in a store of general merchan­
dise, and he is represented by Mr. Pater­
son, of Blaine.
Rev. A. M. Ginn has purchased one
block in Beaver and the sound of the
hammer and saw are heard already, as
he is erecting a dwelling house.
Alva Finley’s house caught tire on
Monday, but was soon put out, with
little damage.
Another Missourian and family came
in last week and went on up to Blaine to
locate.
The Free Methodists have got two
