The people of Tillamook City do ordain as follows: Sec. i. That a certain contract entered into by and between Tillamook City, Oregon, a Munici­ pal corporation, and one H. Orchard, wherein I the said Orchard contracted to «upply Baid city with water and wherein it was provided among other things that the water pipe to be used oil certain streets of said City should be eight inch pipe, may be modified as follows at the option of the said H. Orchard to wit:— that wherever said contract provided that the said H. Orchard should supply eight inch pipe on certain streets of said city, he may in lien thereof furnish six inch pipe at his option, pro­ vided that nothing in this ordinance shall relieve the said H.
