THE QUADRANT
THE CASE ADVANCED TO
NEXT MARCH.
Following regarding the
quadrant
ease, which concerns some of the set
tiers of this county, is taken from the
Forest Grove Times :
The Quadrant ease has been advanced
to .March next on the calendar of the
Supreme Court of the United States
Coming up in its regular order it might
have been years before it would have
been reached mid we people of this sec
tion may well congratulate ourselves on
the new mid just arrangement that
promises the speedy settlement of n
question involving the interests of a
great number of people. We have ex
pressed the opinion that the govern
ment will win the suit. This opinion
is founded on the facts and history of
the case
In nil the decisions by the
department mid by the courts on the
point only one has been given in favor
of the railroad company, Hint the latest
one by the circuit court of appeals, ex
cept an opinion by Judge Dendy given
incidentally. The (nets me ns follows:
By mi act of congress passed in 1870
hinds were granted the Oregon Central
Railroad Co., for the construction of a
road from Portland to Astoria mid from
a suitable point of junction near Foiest
Grove to the Yamhill river.
In 1872
20 miles of the road were built mid ac
cepted by the secretary of interion mid
in 1876 27 miles more had been built
and were accepted.
But the section
from Forest Grove to Astoria was not
built and in 1885 congress passed mi
act declaring forfeited the lami contigu
ous to the surveyed route between
these points
The commissioners of
the general hind oilice at Washington
t hereupon issued constructions to I lie
register and receiver of the land office at
Oregon City for their guidance, mid
plats, uu which the quadrant in dispute
was marked "forfeited,” mid these in
structions were affirmed later by the
secretary of the interior
In this same
year the receiver of the O. AC. R R
brought suit in the U. 8. Circuit court,
Dendy, judge, to restrain the regislei
and receiver from permitting filings
within the quadrant, but the case was
decided on a demurrer against the rail
road company. In 1887 Secretary of
the Interior Lamar reviewed the in
structions of the commisaioner mid gave
Ids opinion ill support of the govern
ment's claim.
In 1891 the railroad
brought a suit in equity in the U.S.
circuit court against a number of set
tici« to quiet lille, which was decided
against the railroad on a subordinate
point of luw. The government brought
a suit in equity in 1892 to quel title,
which was recently decided by Judge
Bellinger against the railload, which
wss carried to circuit court of appeals
ami won by the railroad eoiupiiny, was
again appealed to the Siiprrine court ol
the Uniteli States, and w hich is to be
settled filially in a few inc ill he
The

whether the grant was for two roads,
one from Portland to Astoria and from
Forest Grove to the Yamhill river, or
was. as the railroad company claims,
for one road from Portland Io Astoria
mid from I’ortlmnl to McMinnville. In
the former case, the giant fortlie first
portion of the road would be earned as
far as Forest Grove and to a line a right
angles with the road ; It would also be
earned on the road going south, from a
point beginning at Fores* Grove unit at
right angles to this part of the road,
