2006). Either party may term i­
nate the agreement through a
lengthy 120-day process. How­
ever, the city may terminate the
agreement at any time in the
event that funding is not avail­
able to fulfill the cities obliga­
tion. In addition to the officers,
the county will provide all
equipm ent necessary to pro­
vide services including vehi­
cles. The city is required to pro­
vide a furnished office, includ­
ing computers, and office sup­
plies as needed. Deegan told
council that insurance costs for
next year would be dramatical­
ly reduced, by about $13,000,
because liability insurance for
police services is included in
the contract.
Council created the office of
police commissioner and ap­
pointed Branstitre to the posi­
tion which will serve as liaison
and agent in matters regarding
the providing of police services.
Council also adopted a resolu­
tion to disburse police depart­
ment equipment. Four cars will
be sold, with proceeds going
towards offsetting the cost of
contract services. One comput­
er will be donated to the library,
a laptop computer and projec­
tor will be transferred to the city
for presentations, and a digital
camera will go to the water de­
partment.
Lyda told council that he has
continued his discussions with
the Department of Justice con­
cerning repayment of COPS
grant money. City recorder De­
bra Deegan told council that
the money was awarded and
spent on police services. How­
ever, while the North Plains
grant was for an established
agency the Banks grant was for
a start-up agency. Unfortunate­
ly, personnel administrating the
grant at the time did not realize
that officers could not be trans­
ferred from North Plains to
Banks at the same rate of pay.
When officers were transferred,
following the failure of a bond in
North Plains, they were trans-
ferred at the same rate of pay
which was higher than that al­
lowed under the terms of the
Banks grant.
Lyda proposed a five-year
paym ent period beginning in
December. He told council that
this would allow council time to
continue to seek other rem e­
dies. Pete Edison said, “ It’s
ridiculous to repay a police
services grant when the m on­
ey was spent for com m unity
policing.”

Works supervisor, told council
that well drilling was complet­
ed. At the time, council ap­
proved the base bid of $76,048,
they also approved additional
drilling to maximize water deliv­
ery. Council approved an addi­
tional $3,787 for drilling an ad­
ditional 167 feet. The complet­
ed well delivered over 500 gal­
lons per minute, exceeding the
present well by 200 gallons per
minute. The city will now be
able to perfect the current well
permit and obtain a water right
of 300 gallons per minute at
this location. Grossnickle told
council that he does not expect
water curtailment this year.
