an application to FEMA requesting a
CLOMA, as a small portion of the project
is located in a floodplain. No activities
will occur on the site until receipt of a
CLOMA from FEMA.

An Environmental Review Record re­
specting the within project has been
made by the Oregon Housing and Com­
munity Services Department which docu­
ments the environmental review of the
project and more fully sets forth the rea­
sons why such Statem ent is no, re­
quired. This Environm ental Review
Record is on file and is available for pub­
lic examination and copying upon re­
quest at the Department at 1600 State
Street, Salem, Oregon between the
hours of 8:00 a.m. and 5:00 p.m.
It has been determined that such re­
quest for release of funds will not consti­
tute an action significantly affecting the
quality of the human environment; and,
accordingly the Oregon Housing and
Community Services Department has
decided not to prepare an Environmental
Impact Statement under the National En­
vironmental Policy Act of 1969 (PL 91-
190).
The reasons for such decision not to
prepare such Statement are as follows:
No further environmental review of
such project is proposed to be conducted
prior to the request for release of Federal
funds.
All interested agencies, groups and
persons disagreeing with this decision
are invited to submit written comments
for consideration by the Oregon Housing
and Community Services Department.

velopment Ac, of 1992. The Oregon
Housing and Community Services De­
partment is certifying to HUD that the
Department and Lynn Schoessler in his
official capacity as Certifying Officer,
consent to accept the jurisdiction of the
Federal courts if an acion is brought to
enforce responsibilities in relation to en­
vironmental reviews, decisionmaking,
and action; and that these responsibili­
ties have been satisfied. The legal effect
of the certification is that upon approval,
Community Action Team may use the
HOME Investment Partnership Program
funds, and the Department will have sat­
isfied its responsibilities under the Na­
tional Enviromental Policy Ac, of 1969.
The U.S. Department of Housing and Ur­
ban Development will accept an objec­
tion to its approval of the release of
funds and acceptance of the certification
only if it is on one of the following basis:
(a) That the certification was no, in fact
executed by the certifying officer of the
Department; or (b) tha, the environmen­
tal review record for the project indicates
omission of a required decision, finding,
or step applicable to the project in the
environmental review process. Objec­
tions must be prepared and submitted in
accordance with the required procedure
(24 CFR Part 58), and may be ad­
dressed to the U.S. Department of Hous­
ing and Urban Development, Portland
Office, Region X, Attention: Roy Scholl,
400 Southwest Sixth Avenue, Suite 700,
Portland, Oregon 97204-1632. Objec­
tions to the release of funds on basis
other than those stated above will not be
considered by HUD. No objection re-
