passer-by reported seeing
him and called Cannon
Beach Police.
When Deviney was
asked his name, he simply
said, “I’m the guy you’re
looking for.”
Deviney allegedly kid-
napped the girl May 9 in
Sanger, Calif. He left her
and his 2004 Nissan Pick-
up at McDonald’s in Asto-
ria May 11.
The girl was later re-
united with her family.

Russell Wayne Devin-
ey, the Everett, Wash.,
man accused of kidnap-
ping and raping a 15-year-
old California girl, plead-
ed not guilty Friday, May
22, in Clatsop County
Circuit Court to 12 felony
charges.
Deviney, 48, was ar-
rested May 14 just south
of Cannon Beach on six
charges. The charges
were doubled after a
grand jury met Thursday.
A grand jury indicted
Deviney for first-degree
kidnapping, two counts
of first-degree rape, two
counts of first-degree
unlawful sexual pene-
tration, two counts of
first-degree sodomy, two
counts of using a child
in a display of sexually
explicit conduct for pho-
tographing the girl na-
ked, and three counts of
first-degree sexual abuse.
He made an initial
court appearanceMay 15,
when his bail was set at
$1 million.
District Attorney Josh
Marquis requested the

high bail amount after
discovering Deviney had
assets from former em-
ployment with Microsoft.
In court Friday, Judge
Philip Nelson continued
the $1 million bail.
Deviney’s
appointed
defense lawyer James von
Boeckmann argued that
Deviney no longer has the
assets the state believes.
As a result, von Boeck-
mann plans to ask for a
bail hearing for the court
Deviney allegedly sex-
ually assaulted the girl at
an Oregon rest area. The
charges against Deviney
claimed the alleged crimes
occurred in Clatsop County.
He has no local ties to
Clatsop County and there
is no indication Astoria
was his intended destina-
tion, according to Astoria
Police.
Marquis said other
jurisdictions could also
charge Deviney.
Deviney is due back in
court at 10:30 a.m. June
12 for an early resolution
conference.
Seaside drowning incident
A Lacey, Wash., man
died after a drowning acci-
dent in Seaside the morning
of May 13.
At about 3:15 a.m., Sea-
side Fire & Rescue was
called to an incident near
the Avenue A approach at
the beach.
The Seaside Police De-
partment had reported
someone missing around 26
Avenue A at about 2:59 a.m.

tion. The man was suffering
cardiac arrest, according to
Capt. Dave Rankin, of Sea-

ported the man to Provi-
dence Seaside Hospital.
The victim died.
The agencies will not re-
lease the man’s age, name
or other identifying infor-
mation at this time because
the incident is under inves-
tigation, according to the
police department.
