Expectation to Sell for Profit After
Final Proof Not Unlawful.
The following letter is in answer to a
communication to the General Land
Office from Chas. W. Strothers, a young
attorney of Yreka, who concluded to
ascertain beyond question his status be­
fore making final proof on a claim on
which he had filed.
He stated plainly that he hail no in­
tention of living on the land or indivi­
dually making any personal use of the
timber thereon, but that the entry was
made by him for his own use and bene­
fit, in the sense that he intended to hold
the same until he could sell to advan­
tage in the future.
He stated that he desired to know
whether there was a prospect of his pat­
ent being held up by the department
and liis money forfeited in case he
should proceed to prove up. The reply
should effectually dispel all doubts con
cerning the rights of individuals in the
premises:
“Washington, D. C.—Mr. Charles W.
Strother, Lawyer, Yreka—Dear Sir: Re­
ferring to your letter of 29th ult., rela­
tive to the suspension of your timber
and stone entry, you are advised that if
you made a satisfactory showing that
your entry was made for your own use
and benefit and there is nothing more to
impeach your good faith than the mere
fact that you made the entry for invest­
ment with intent to sell the land at
some future indefinite time and in this
manner realise a profit on the money in­
vested, this office holds that such an en­
try is not made in violation of law aDd
should be passed to patent.
