Supreme Court Decisions
Cited In Support of
Contending Heads
WASHINGTON, Nov. 28 (United
Proea) Buried sword of the sen
ate La'Kollette adherent and re
publicans, laid away after the last
presidential campaign, were being
dug up tonight for the expected bat
tle over seating the non-partisan
leaguer, Senator Gerald P, Nye, of
North Dakota.
Development tonight turned what
appeared to bo a minor routine af
fair Into a major party Issue. Un
less some peace proposals aro work
ed out, the conflict will break out
on the floor of the senate as soon
as congress convene a week from
Monday. .
Pouring over law books, republi
can leader and Nye sympathiser
bare collected precedent, casting
some doubt on the validity of Nye's
right to a senate seat.
Three supreme court decisions
hare been found by the administra
tion workers to show that a con
gressman Is not a state official.
From this It Is argued that Got.
So r lie had no right to appoint Nye
without specific authority, on state
laws, or the North Dakota legisla
ture. Nye's synipathlxera assert that
these decisions do not bold that the
gorernor ha no power to appoint
without specific authorization.
Both aides hope for a ruling on
the question, which will set a prec -
edent for the future.
