SENATOR WHEELER TO
RENEW FRAUD FIGHT
(Continued from rage One)
and the authority of 4he district
court to handle the case.
"The district Court not a fed
eral court," Walsh declared. "It
is the equivalent of a state court
and cannot try federal . cases."
Walsh's strongest plea was based
'upon the double Jeopardy charge, j
"We must consider as settled,"
he said, "the issue of fact raised
in the Montana case, which is the
same as that raised here, namely,
that Wheeler used his influence
wlUi the department of Interior to
urge approval of -certain permits to
prospect for oil and gas."
Walsh further declared that tbc
defendant1 ' was charged - by ha
government merely with violating
' an "Interpretation of the law." Al
though not admitting that his
client had even violated the govern
" meat's' interpretation' defense coun
sel pointed out that the federal
law did not limit the number of
prospecting permits that might be
taken out. -
Arguments were scheduled to
continue Saturday.
