In an attempt by the atate to prove
the threo men were responsible for
ber death.
As the second day of testimony
taking drew to a close late Friday
the prosecution brought out Its
prlie evldonce Mii Oberholuer's
dying atatement and asked per
mlaalon to place It before the jury.
Judge Will Kparka, hearing the
case against the 'former grand
dragon of the state Ku Klux Klan
and hla two henchmen, ruled the
atatement could be Introduced.
Tbo rending of the dying girl's
own words, undoubtedly will mark
a climax in this case which has
attracted such wide attention. The
contents of the statement already
baa been made known.
It relates that Miss Oberholtxor,
sn Indianapolis social worker was
enticed to Stephenson'a mansion
last March on the pretense of bus
iness. There the statement says,
she waa made dluy by wine that
Stephenson forced her to drink and
then waa carrlod oil to a train.
In a drawing room of a aleep
Ing car Sephenson and Klcnck are
accused of attacking her. Much of
tho detail of this episode, as out
lined by the statement. Is unprint
able. It was here, the atatement
says, that Miss Oberholtzcr re
ceived the brnlses and lacerations
with which she was disfigured
when brought back to her Ind
lanoplli homo two days .later.
In a Hammond, Ind. hotel ' to
which Stephenson and his aides
are alleged to, have taken her. Miss
Oberholtter swallowed poison. There
Is a dispute as lo .Whether ahe died
of the poison that she swallowed
or of blood poiscning resulting
from her wounds.
Judge Spsrks' ruling on the atate
ment came at the end of a day re
plete with legal wrangling. When
court opened attorneys for the de
fense asked the Judgo to dismiss
the Jurors on the grounds they had
been prejudiced by this atatement
of the court:
"It Is the duty of the Jury to de
cide whether a very virtuous young
woman would regard her virtue as
dearer than her life."
Judge Sparks reserved a decision
on the defense motion until after
noon and then overruled It. Indi
cations thst defense attorneys will
