IN LIBEL SUIT
A motion will be made by counsel
for V.'. 1. Myers this morning In
his civil suit against the Evening
Herald for alleged libellous state
ments, asking for a Judgment on the
pleadings. In other words, Myers'
attorneys will ask that the Judge
hand down his decision on tho case
for $10,000 libel today. Should the
Judge deny this motion .the case
will be postponed to be heard in
about Blx weeks, after the Elliott
case Is finished.

A demurrer filed by counsel for
the Evening Herald was thrown out
of court after Judgo J'ercy It Kelly
heard Attorney Irwin for the Even
ing Herald present his argument.
"I cannot agree with the defend
ant," Judge Kelly declared. "If
the statements made by the Evening
Herald were false, regarding Mr.
Myers' misconduct In office, and If
they can be proven false, then the
statements are libellous."
The complainant's side of the ac
tion for demurrer was not heard by
the Judge, he having made bis de
cision on the argument of Attorney
Irwin.

It is expected that the eggs will

fried frog legs will be a bit of
dellcacv common to the Klamath
