Ballot Title

Supreme Court, in a 5-2 split de
cision, today overthrew Atty.
Gen. Robert Y. Thornton's pro
posed ballot title (or the initia
tive measure to close the state's
waters to commercial salmon
and steelhead fishing.
It substituted the title pro
posed by opponents o( the mea
sure. The action paves the way for
the Save Our Salmon and Steel
head, Inc., to begin circulation
of petitions to get the contro
versial measure on the Novem
ber, J064, ballot.
The initiative petition ki
filed with the secretary of state
on Aug. 8. The group was filed
with the secretary of state on
Aug. 8. The group has until July
2, 19G4, to gather 37,0116 valid
signatures.
It proposes to close all the
state's inland waters, including
the Columbia River, to com
mercial salmon and steelhead
fishing.
The title assigned by Thorn
ton read "Prohibits commercial
fishing for salmon and steelhead
in all Oregon inland waters, in
cluding boundary rivers. Pro
hibits all commercial dealings
in fish taken illegally."
The Columbia River Salmon
and Tuna Packers Association
challenged the final four words
of Thornton's title, and asked
that "fish taken in prohibited
areas" be substituted.
Today's Supreme C o u r t ac
tion made the substitution.
Justice Hall S. Lusk, with
Justice Kenneth J. O'Connell
joining, dissented, and said
Thornton's title met legal re
quirements, and the court
should not disapprove a title
"simply because it feels it can
write a better one."
The majority opinion by Jus
tice George Rnssman said the
language in the substituted title
"minimizes the possibility that
a leader will surmise that un
less this measure is adopted,
Oregon will have no law that
prohibits commercial dealings in
salmon and steelhead that were
taken illegally."

Chapel Planned

chapel has not been used since

revolutionary committee which
seized power last week contend
that the controversial Nhu. who
died along with Diem in the up
rising, had been negotiating for
possible reunilication of Com
munist North Viet Nam and
South Viet Nam under a "neu
tral" banner.
American authorities can
not confirm all the details but
they have independent evidence
that, at the very least, Nhu was
in touch with Red leaders in
Hanoi.
This was disclosed Tuesday
as Secretary of State Dean
Rusk expressed the hope that
the United Stales could recog
nize the new Saigon regime

today wound up his
two-fold campaign for winning
a seat in the House of Com
mons and halting the Conserva
tive party's slide toward possi
ble defeat in the next general
elections.
Residents of the constituency
of Kinross-West -Perthshire will
vote in a by-election Thursday
to pick a representative from a
slate of candidates including
the 60-ycar-old prime minister,
who gave up his ancient title
last month, and six opponents.
The result will be known Fri
day. Douglas-Home is expected to
win, but the size of his major
ity is considered vitally impor
tant to his party.
Liberal candidate Alastair D.
Millar, a "local landowner, is
expected to provide the stiffest
opposition. The liberals did not
contest Uie Kinross scat in the
last general elections, and the
party is expected to draw more
votes away from Douglas-Home
than the Labor parly candi
date, Andrew Forrester.
With the next general elec
tions due any time within the
next 11 months, the Conserva
tives have little time to build
the prime minister into a solid
vote-getter.
An impressive victory here
would be a good first step. A
sharply reduced majority could
be disastrous.
