On Fireworks
If you're planning to entertain
your family with fireworks
July 4 make sure it's only with
sparklers. All types of explod
ing devices including small fire
crackers are not legal in this
state.
If you want to see fireworks,
however, plan to see the city
fire department go to work on
"K" Hill in their annual July
celebration. The show will start
at about 10 p.m. and all types of
exploding sky rockets and aerial
bombs will be set off.
Even the city (ire department
needs special permission however,
and the annual event has been
authorized by the city council
and the state fire marshal.
Funds for the fireworks show
come from the licensing of the

Russell Wayne Long, 22, con
victed of causing a prisoner to
escape, has been placed on one
vear s probation by Judgei Don
ald A. W. Piper, it developed in
Klamath County Circuit Court.
Judge Piper imposed the pro
bation upon Russell after first
sentencing him to a six-month
term in the county jail, with
four months suspended. Russell
received credit tor the lime he
served in jail since his arrest on
April 23, when he was appre
hended for attempting lo aid
Klamath Falls man escape from
city police.
Long was one of four men ar
rested by local police in connec
tion with causing destruction to a
service station restroom.
After the incident was report'
ed, the lour men were arrested
along Main Street and engaged in!
a scuffle with police. They were
finally subdued and booked at
the city jail on disorderly conduct.
Supreme Court Declines Appeal On Jury Prejudice Charge
Firm Gets Spill Work
ALTURAS Paul Steel, manag
er of the Modoc Fish and Wildlife,
Refuge, announced this week that
work will begin the first of July
the construction of a new 50-
foot concrete and steel spillway
on Parker Creek.
Steel said the contract for the
onstruction had been let to the
low bidder. Gill Construction Com
pany of LaFayctte, Calif. Gill bid
$18,580 for construction of the new
structure which will be 10 feet
wide and carry a five foot
depth of water.
The spillway now in use was
built in 1928 by the Dorris ranch
es. In the fall and w inter of 1962
the spillway washed out. Both
times temporary rebuilding wasl
done to alleviate the flooding and
water loss. In 19U3, the spillway
again washed out and was again
temporarily dammed with rock
and dirt fill.

er Creek is one of the sources

Steel said Wednesday, "When it
is completed, the new spillway
will permit the maximum use of
our water permit to the Dorris
Reservoir and control 80 per cent1
of the spring run-off floods." He
pointed out that it would be im
possible to completely control all
the water during extremely wet
years when the run-off water can
reach 5,000 second feet for short
periods and floods the surround
ing meadow lands.

It continued, "The bald asser
tion of systematic exclusion of a
particular race is insufficient in
the face of public records showing
that Indians constituted a negli
gible proportion of persons eligi
ble for jury duty in Harney Coun
ty."
The court also remarked that
Anderson had appealed his con
viction twice before to the Su
preme Court, and in both in
stances the appeals were denied.
In those appeals, Anderson did
not present objections on the
ground of prejudice. He should
have raised those matters then,
the court stated.
In addition, Anderson and his
counsel should have challenged
(lie jury before instead of after its
verdict, the court ruled.
