Southern Issues Undecided Despite High Court Ruling
WASHINGTON (UPD-The Su
preme Court has momentarily re
moved the sting from Southern
sit-in prosecutions, but the great
issue posed by the cases remains
undecided.
It is: Docs a business establish
ment open to the general public
have a right to choose its own
customers?
This blockbuster was reserved
by the court at least until next
term.
It could be speculated that the
short step the court took Monday
was all it felt the country could
stand in view of current racial un
rest. But the truth is that no one
but the nine justices know why
tlicy do things, and they aren't
telling.

Bids Sought For Road,
Campground Projects
Campground and road construc
tion projects planned for construc
tion on tin Winema Forest have
recently been announced and bids
have been called for by the re
gional forester.
In the Lake of the Woods area
it is planned to reconstruct por
tions of the road along the cast
side of the lake and provide a
new entrance onto the Dead In
dian Highway. Also included in
this project u additional surlacing
for the campground roads at As
pen Boint. Interested contractors
should submit their bids not later
than 4 p.m., Pacific Daylight
Time. June II, 19ta. to the Re
gional Forester, P.O. Box 3632.

A second project offered for bid
in the Lake of the Woods area
will involve a new entrance to the
castside summer home area. Bids

not later than 1 p.m. June 14 by
the regional forester.
A third contract is being olfcrcd
(or construction of a campground
road at Miller Lake in the north
ern Dart of Klamath County west
of Chemult. Bids on this job will
be received on June II at 3 p.m.

'No Winners'

United States will ever be able to

The veteran diplomat, speaking
at Stanford University, Monday
deplored the view that the cold
war must produce "a winner and
a loser."
He said the United States will
never dominate the world because
it doesn't want to. Its central pur
pose must be to create a peace
ful world community of nations
free to develop in their own kinds
of societies for free men, he said.
The Soviets, according to
Bowles, are committed to building
a world Communist society, but
they will fail because the Com
munists cannot cope with the fact
that the world is refusing to act
as their ideology said it would.

tion. Chief Justice Earl Warren held
in the court's decision that local
laws and edicts had deprived busi
nessmen of their freedom of
choice as to who could be served

ion was that so long as these laws
are on the books the proprietor of
a store is presumed to act under
them, What he would do, if left
lo himself is beside the point at
the moment, under the decision.
In one case, from New Orleans,
there was no local segregation
ordinance. But Warren said state
ments by the mayor and the po
lice superintendent amounted to
tlie same thing.
Will Free Demonstrators
This handling of tlie touchy "sit
in" issue was urged on the court
by the Justice Department in ac
cordance with the time-honored
principle that a major constitu
tional decision is always avoid
ed if a case can be disposed of
on narrower grounds.
As it is, the decision will free
hundreds of demonstrators who
took part in the ltKiO-61 sit-in
movement in places having simi
lar segregation ordinances. They
have been free on bond awaiting
tlie results of Monday's cases,
which came from Greenville, S.C.,
Birmingham, Ala., and Durham.
N.C., in addition to New Orleans.
The ruling had the prcculiar re
sult of barring discrimination in
cities where there are local ordi
nances requiring segregation, and ,
leaving tlie whole matter up in
the air in cities which do not
have such ordinances.
The suggestion was made dur
ing November arguments that a
decision like Monday's might well
result in a rush to get such ordi
nances off tlie books.
Justice Harlan Dissents
Only Justice John iM. Harlan
dissented from the court's reason-1
ing in the sit-in cases. He said:
' "Freedom of the Individual to
choose his associates or his.neigh
bors, to use and dispose of his
property as he sees fit, to be irra
tional, arbitrary, capricious, even
unjust in his personal relations
are things all entitled to a large
measure of protection from gov
ernmental interference."
