SALEM (LTD - A bill that
would have given a driver sus
pected of drunkenness the choice
ol taking a chemical test or losing
his license went down to narrow
defeat Friday in the Senate.
The "implied consent bill," was
defeated, 15-13, afler opponents
termed it an invasion of individual
rights that could lay the grounds
for harassment of motorists.
The bill, one of a package of
traffic safety measures urged by
the governor, was based on the
premise that a driver implies his
consent to a chemical test wncn
he accepts a driver's license. Sup
porters said driving on the high
ways should be considered a privi.

The bill would have allowed a
policeman to arrest a suspected
drunken driver and request a
chemical test. If the driver re
fused, he would have lost his li
cense. He could have asked for a
hearing within 10 days. If his li
cense were not restored, he could
have appealed.
Sen. Anthony Yturri, R-Onlario,
asked the Senate to consider the
rights of innocent motorists whose
blood is shed because of the
drunken driver. He said the bill
could reduce highway dealhs in
Oregon by as much as 100 a
year.
Yturri said the constitutionality
of such a measure has been up
held in every court where It has
been tested. Ho cited substantial
reductions in highway accidents
in Scandinavian countries where
such laws are in force.
Sen. Waller Pearson, D - Port
land, retorted the measure would
deprive the motorist of his rights
without due process of law. He
said It would open the door to
harassment. And he said the tests
would be inconclusive, since some
persons could drive well after
more drinks than could others.
Sen. Vernon Cook, D-Grcsham,
called it a Riealer violation of
rights than wire-tapping. He said
it would force "their very bodies
to testify against themselves."
Voting against the bill were

gel, Hallock, Hare. Huston, Mon-
aghan, Naterlin, Newbry, Pear
son, Potts. Stadlcr, Thlel, Willnor'
