AMA Urges
New Drunk
Guilt Level

ficials of the American Medical
Association have urged a drastic
tightening of Qemistry standards
bv which many states seek to es
tablish guilt of drunkenness o(
drunken driving.
One of the AMA's experts on
alcoholism said that if the rec
ommendation is written into state
laws, a person could be declared
legally drunk by chemical tests
alone ruling out any counter ar
gument by a defense lawyer.
The recommendation came
from the. AMA's Board of Trus
tees. The policy-making House of
Pelegates was to consider it later
The trustees' recommendation,
based on studies by I wo AMA
committees, is that states using
chemical tests of blood or breath
ior alcohol content make these
change in their statutes:
1. Lower by one-third the level
ef alcohol concentration on which
a person can be legally presumed
to be under the influence of in
toxicants. Specifically, the change
would be from 0.15 per cent to
(t 10 per cent. The AMA itself
first recommended the 0.15 per
cent level more than 20 years ago.
2. Change the wording of stat
utes so that the word "intoxica
tion" would be substituted for the
present "under the influence."
Dr. Marvin A. Block of Buf
falo. N.' V., chairman of the
AMA's committee on alcoholism,:
was asked by a reporter to es-j
plain the significance of the pro
posal. "This means that not only
would we have a stricter criteri
on, but wt'd also hae real teeth

the first time." he replied.
"The present phrasing 'under
the influence' is a very vague
term which depends on someone's
judgment.

tion, the chemical level of alco
hol in the blood or the breath
would be enough to convict a man
of intoxication. The court wouldn't
need any more evidence."
Contending that tin 0.10 per
cent level is a fair one. Dr. Block
said: "People who carry that per
centage of alcohol in their blood
have their faculties affected.
Their reflexes are slowed, their
judgment impaired, their inhibi
tions lowered.
"And this is true even though
some people due to differences
in tolerance to alcohol would ap
pear not to be drunk under such
circumstances."

Deny Charges
SAN FRANCISCO (AP)-Threc
Californians Tuesday denied
charges stemming from the theft
of $58,000 worth of money orders
from the postal substation at Four
Corners near Salem, Ore.
Sam Phillips, 38: Harold G.
Martin, 31, and Clarence E.
Greenlee, 20, pleaded innocent to
charges of conspiring to counter-!
feit postal money orders. They
also pleaded innocent to a charge
of possessing a money order
stamp.
The money order blanks were
taken Nov. 6. The men were ar
rested Nov. 11 in San Pablo
motels.
Their trial is scheduled for U. S.
District Court Dec. 6. .
