Elkins' attorneys said the indict
ment should be dismissed be
cause one of the counts of con
spiracy did not result in a burglary.
In his ruling. Redding said
"Each and all of the grounds
in the demurrer attacking the in
dictment are without merit
"Our statute was clearly in
tended as a potent deterrent to
conspiratorial plotiing to violate
the laws of this state and lo pro
vide an effective means ol defeat
ing its purpose by punishing the
conspirators, irrespective of the
fact that the contemplated crimes
were consummated or frustrat
ed." the judge said.

planning to resign as Republican
national chairman a position he

Alcorn declined comment. He

able comics, George Burns and
Milton Berle. are going into the
television production business.
They announced Tuesday that
they have formed B & B. produc
tions and will first tackle a series
of 39 half-hour filmed shows. Berle
who has spent many years in live
TV. will star in 13 of the canned
programs and act as host on all
of them. Burns will be executive
producer.
The format calls for situation,
farce and musical comedy and
variety programs.
