court against Dixon-Yates by this
time, trying to recover some of
the real damages suffered bv the
government through the conflict o!
interest which permeates this en
tire contract."
The Atomic Energy Commission,
which negotiated the contract for
a 107-mi.lion-dollar private power
plant with the Dixon-Yates group
at President Elsenhower's direc
tion, repudiated the contract last
month. It -based its action on an
opinion by A EC General Counsel
William Mitchell that Adolphe H.
Wenzell served a,s an adviser to
the government in the contract
talks "while having a conflicting
private interest."
Dixon-Yates challenged this con
tention in the suit it filed yester
day. Wenzell was a Buduet Bureau
; consultant during this period while
also serving as a too official of
financial house that later beramo
fiscal agent lor the Dixon-Yates
group.

Shot In Hunt
A U.S. Air Force captain was
a shocting victim on December 10.

The officer was shot by an un
identified hunter as he stooped to
pick up fire wood two miles north
of the California state quarantine
station. The bullet from a high-
powered rifle passed through the
lower hips from the rear, splin
tering the pelvic bones.
He was taken to the Modoc Med
ical Center, Alturas, by ambulance
from that city.
Gerald C. Wilson, Modoc Coun
ty deputy sheriff, in reconstruct
ing the accident, said "bullets were
flying everywhere," when Del Bax

patrolman, were acivised of the ac
