opened a new legal battle today
In his seven-year light, to- escape
death in the San Quentin Prison
gas chamber.
Chessman, the so-called "Red
Light Bandit" of Los Angeles,
was to appear before Federal
, Judge Louis E. Goodman, who
will set a date for a bearing on
his petition for a new trial.
Prison officials said the 34-year-old
convict would be dressed In a
civilian business suit, shirt and tie
lor his first day outside San Quen
tin Prison in 3", years.
They planned to take "every
precaution to assure against
possible escape attempt.
Irving Ritter, acting warden of
tan nuentin, said cnessman would
be handcuffed and shackled with
leg irons for the 40-minute ride
irom San quentin to San Fran.

facilities for feeding Chessman.
After the hearing, Chessman
was to be returned directly to the
prison "unless the court so orders
otherwise."
Chessman's attorney. George T.
Davis, said he would ask the court
to order Chessman held in San
Francisco County Jail where he
would be "easily accessible."
Chessman, the author of the
best-selling, autobiography, "Cell
2455. Death Row," was convicted
in 1948 on 17 counts of kidnaping,
robbery and rape. He has won
eight stays of execution since
then.
Last month, Chessman succeed
ed in persuading the U.S. Su
preme Court to grant him a hear
ing on his petition for a writ of
habeas corpus.
The source' said Treasury Sec
retary George M. Humphrey and
Budget Director Rowland R.
Hughes would urge the delay at
a conference this morning with
President Elsenhower.
Humphrey tipped his hand In a
St. Louis press conference and
speech Wednesday night In stating
that he opposed a tax cut at
the present time" because of the
nation's defense needs. But he said
he still thinks the budget can be
balanced by the end of the cur
rent fiscal year on the basis of
present estimates of incoming revenue.
Mr. Eisenhower planned to drive
from his Gettysburg farm to the
presidential retreat at Thurmont,
Md 22 miles away, for talks with
Humphrey and Hughes prior to a
later meeting of the National Se
curity Council.

Dulles and Defense Secretary
Charles E. Wilson were invited to
sit in on the discussion about taxes
presumably because defense and
foreign aid budgets are two prune
Items in the fiscal outlook.
The source said Humphrey and
Hughes think the administration
would be In a better position to
talk about lax cuts after it has
determined ' definitely that the
budget for the current fiscal year
ending June 30 can be balanced.
After the discussion on taxes,
the President was ready to turn
to consideration of cold war prob
lems at the National Security
Council meeting. A priority topic
for discussion at the secret session
was likely to be the new war of
nerves in Berlin.
Any delay in administration re
quests for a tax cut could be ex
pected to set off a sharp political
debate. Both parties want quick
action on a tax cut as a politically
strategic move with the voters for
the 1956 presidential campaign.
Senate Democratic Leader Lyn
don B. Johnson (Tex) already has
said that "tax revision to benefit
the low income groups" would be
part of the legislative program
which the Democrats hope to put
over in Congress.
Administration leaders were
thought to have clearad the way
for their tax reduction proposal
earlier this week when it was
agreed to hold defense spending
for the new fiscal year at 34,
500.000,000 about the same level
as this year.
There has been speculation that
the administration would propose
giving lower Income groups higher
tax exemptions, coupled with tax
relief for those in higher brackets,
The president will drive back to
his Gettysburg farm tonight after
the Security Council session. He
will return to the presidential re
treat Friday for a cabinet meet
ing and drive to Washington on
Saturday.

terday in Cedars of Lebanon Hos
pital. His wife Ida said he stood
the operation well and that late in
the day "he was singing and talk-

up two drug store clerks last night
while a dozen shoppers wandered
about the store didn't overlook a
thing. Clerk Craig Swanson hand
ed the bandit a bunch of bills
from the cash register. The bandit
took a swift look as he turned to
leave, saw a (1 bill and three
rolls of pennies remaining in the
till. He asked for them.

VAN NUYS, Calif, m When
Mrs. Phyllis A. Loughlin's auto
collided with another, she was
thrown to the street. Her car spun
around and ran over her. Police
said she was killed by her own
car. Joseph Dorfman, driver of
the other car, was hospitalized
with head injuries.
