The new indictment alleges that
Lattimore lied when he told the
Senate Internal Security subcom
mittee In 1952 that he (1) had nev
er been a follower of the Commu
nist line and 121 had never been
a promoter of Communist inter
ests. ,
It was returned after Judge
Youngdahl had dismissed as too
vague the key count of an earlier
indictment which charged that Lat
timore lied in denying that he was
a Communist sympathizer or pro
moter of Red causes. The U. S.
Court of Appeals upheld the dis
missal by an 8-1 vote, but rein
stated two other counts which
Youngdahl had thrown out.
Lattimore has denied allegations
of procommunlsm.

would not be disappointed if sev
eral days elapsed before a formal
answer came.
"The answer may come direct
ly, It may come roundabout," the
spokesman said.
He added that it was too soon
to think about setting a deadline
for a reply.
