were convicted by a federal court
jury yesterday in the $11,500 hold
up June 28 of the Trenton State
Bank.
Judge Ralph M. Freeman set no
date for sentence.
Three bank employes who had
been tied up by two masked gun

CLEVELAND The Sheppard
murder trial, already deep in sex
and romance with only three Ju
rors seleoted, moved on today to
more legal fencing over venire
men. Two men and i woman have
been tentatively seated lo hear tiie
first degree, murder charges
against Dr. Samuel H. Sheppard,
30-year-old osteopath. Ten other
jurors. Including an alternate, re
main to be chosen.
The name of Miss Susan Hayes,
auburn-hailed and a star prose
cution witness, popped up yester
tiay as defense attorneys argued
unsuccessfully for permission to
ask prospective jurors their view
on adultery.
The state claims Miss Hayes, a
pretty, 24-year-old hospital techni
cian with a cute spray of freckles
across her nose, has admitted sfle
was intimate with Sheppard last
March while both were in Califor
nia. Four months later, July 4.
Sheppard's blonde and pregnant
wltc, Marilyn. 31. was found blud
geoned to death in their home along
Lake Erie.
Sheppard, who pleaded Innocent,
maintained his wile was killed by
a bujhy-haired man who also
knocked him unconscious in a bat
tie that raged through the She
pard home and ended on the lake
shore outside.
Defense Counsel William J. Cor
ligan, told Common Pleas Judge
Edward Blythln that "some peo
ple consider a sexual crime or sex
deviation even worse than mur
der" and later declared, "I know-
that in the evidence they tthe
state) will bring In testimony on
extra-marital relations. . .
Waving an arm toward some 50
reporters packed In the rear ot
the courtroom, Corrlgan demand
ed:. ,
"What flo you suppose all of
these people are here for, these
reporters . . . ? They're here be
cause there's a sex angle In It , . ."
The argument came up when the
iudxe sustained an objection to a
question Corrlgan put to Edmund
L. Verllnger. a 29-yearK)ld hard
ware store manager who was the
third juror selected. Corrigan
asked:
Suppose evidence is produced
that the defendant had affairs with
another woman, or women, would
that produce in you ... a feeling
of ill will towards the defendant
that would prejudice you?"
Defense Attorney Fred W. Gar-
mone first injected the name ot
Miss Hayes into the trial. While
questioning Mrs. Elizabeth A.

Judge Blythin steered the ques
lloning away from the sex opinions
of the prospective Jurors. He told
the defense that "we're not try
ing anyone for any sex offense. . .

Corrigan told reptorters yester
day that he did not think Shep
pard would get a fair and Impar
tial trial in Cuyahoga County. He
lias twice asked Judge Blythin to
postpone the trial and move It to
another county.
Two of the three jurors selected
Monday and yesterday have re
ceived copies of a threatening let
ter which were mailed recently u
several members of the panel. The
two, Mrs. Borke and Verlinger.

is Howard Barrish,, a timekeeper
at a steel firm here.
Sheppard's aging father, Dr,
Richard A. Sheppard, attended the
morning session yesterday. Other
members of the family said the de
