Cases Out
SPOKANE. May 13 M"i Claims

pay were dismissed Tuesday by
Federal Judge Sam M. Driver who
said the union had (ailed to prove
trie 1947 act of congress unconstitu
tional.
The union was given 30 days to
Xile an amended complaint.
The dismissal was granted at the
request of the Howe Sound Mining
company, defendant in a $612,000
action.
Combined with it. however, for the
purpose of argument were suits to

Permanente Metals corporation, the
American Zinc, Lead and Smelting
company, Pend Oreille Mine com
pany, and the Metline Mining and
Leasing company.
Union representatives contended
In their complaints that the portal-
tr.-portal act of 1047 is unconstitu
tional. But Judge Driver ruled that
they failed to produce sufficient
facts to show unreasonable or arbi
trary action by congress in the law's
passage.

Inmate Killed
SEATTLE, May 13 A former !

tavern at 4 a. m. yesterday.
Police Identified the victim as
George Vernon Drake, 38, who was
paroled while serving a prison term
lor robbery. The fatal shooting oc
curred after a chase Into the uni
versity arboretum.
The man was killed outright by
eight shotgun pellets fired by Pa
trolman Howard Belka. They hit
his head.
Police Capt Richard P. Mahoney,
said the dead man was cloutching
a money bag with $13.35 in it and
another with $5.35.

Gold Rush Day
To Be Held In
Yreka Again
One of California's oldest and
most oolorful celebrations will be ;
revived this year at Yreka, Cali
fornia after a lapse of eight years.
It Is the Yreka Oold Rush Days
that will tako place June 24 to 27,
Inclusive, and the four day program
Kill embrace all the old time features
u well as several new ones.
Highlighting the whole affair will
be a mammoth historical parade on
Sunday, June 27, that will attract
entries from many parts of Cali
fornia as well as an equal number
from the cities of Southern Oregon.
There will also be a night torchlight
fun parade on Friday, June 25. Sat- .
urday, June 26 will be given over
to the children who will have a
junior pet parade all of their own
and a picnic and party at the Oold
Way.
The Yreka American Legion is
sponsor of the entire celebration and
much of the program will be held in
the now uncompleted Veteran's '
Memorial building that will be fin
ished this year following the Oold
Rush Days Festival.
Invitations for participation for
the many contests, parades, etc., are
going forward and the committee in
charge extends an invitation to all of
California and Oregon to attend and
be a part of this Golden Celebra
tion.
