OLYMPIA. April 3 (.41 The
American Society ot Composers.
Authors and Publishers (ASCAP!
Friday lost another round in its
court battle to license and collect
fees for public performances of its
members' musical compositions in
Washington.
It lost when the state supreme
court refused to reconsider its de
cision of January 8 which ruled
ASCAP had not complied with a
1947 state law. Compliance with the
law is required before fees can be
collected.
The law prohibits an orgamra-
: tion such as ASCAP from doing
I business in the state unless It first
files with the secretary of state
a list of its copyrighted! works and
supplies certain supporting data as
to each music title,
j ASCAP had maintained it com
plied with the statute by filing a
list of some 80.000 copyrighted works
with Uie secretary of state.
The supreme court held, how
ever, that the list included thous
ands of titles which are in the nub
ile domain, including "Abide With
Me." "Etude." "Minuet in O." and
others.
"The music in the public domain
is the cultural heritage of the peo
ple." the court said in Its January
opinion. "Everyone has the right to
a free and unlim'ted use of it.
ASCAP has no right to receive par
for its public performance for
profit."

Pair Held
After Wreck
SEATTLE. April 3 (Pi An Oregon
college student and a 21-year-old
miner were held without charge In
the city jail Friday after an auto
mobile In which they were riding
plunged through the barriers of a
ferry slip into Lake Washington at
1:30 a.m.
Byron K. Bohm, 23. a student at
Pacific college, Newberg, Ore., and
Shepherd W. Dcmarc, Seattle, were
treated at Harborview county hos
pital and released to police.
Ferries used an adjacent dock
until the car was removed from 20
feet of water at 8 o'clock this morn
ing. Police said the car belonged to K.
S. Williams of Seattle, who said he
left it in a downtown parking lot
at 11 a.m. yesterday.
Both men swam to the dock after
the car sank about 30 feet from
the end of the slip.
Lead Stocks
Show Gains
NEW YORK. April 3 Lead
ing stocks tilted higher here and
there in today's market although
many plvotals did nothing or edged
into minus territory.
Hopes that the coal mine impasse
would be broken, following word of
John L, Lewis to union members
that they could do as they please
about returning to work, propped
bullish sentiment to some extent.
Rearmament prospects aided scat
tered favorites.
Skeptics regarding disturbing in
ternational affairs and labor sit
uations generally continued to hold
aloof. Belief that passage of the tax
and European relief program had
been pretty well discounted market
wise also caused further profit
cashing.
Dealings quickened at intervals
after the opening. Mild irregularity
persisted near the close. Transfers
for the two hours ran to about
500.000 shares.
Bonds were narrow and commod
ities nervous.

Thousands of People
Leave C
aifornia
to become citizens of Oregon so they may enter the race for Sheriff of
Klamath County.
Well, you've all been looking for it, and here it is: So grab onto your
hats and keep your fingers crossed!
We of the Yukon Tavern are plumb disgusted! People are coming to
our Free Drawings by the hundreds, getting used to holding out their
hands for Free Gifts so as to qualify as Sheriff of Klamath County. Now
we don't get the connections, but that's what they tell us anyway. What
makes us so peeved is, that we thought for a long time that they were com
ing here just because they had such a Good Time and 'cause we were giv
ing away so many Nice Prizes, including Pots with hundreds of dollars
in them.
We have thought some of suing Klamath County to recover some of
the great expenses of this free training. But we are in hopes that they will
not all be elected and some of them will come back to the Yukon because
they know that we have the Best Food and Cocktails on earth. And they
also know that if a bottle of liquor is sold any place in the State of Cali
fornia for less than we sell it for at the Yukon they are violating the Cali
fornia fair trade law. Look it up and see for yourself.
Anyway, it is our guess that every night at 8:00 and 11:00 we will
have the house full just because no one can afford to miss the big Fret
Gift Hours. You have to be somewhere at those hours, and Jo and Charley
say, "COME AS YOU ARE."
