Gartin Case
The all-mule circuit court
Jury waa alutcd to get for de
liberation the trial of 26-year-
old Harold Hlchurd Gartin, in
dicted for rape involving a
young Umatilla Indian girl,
early thla afternoon.
Gartin's short defense aeaaion
ended thia morning and his at
torneya, U. S. Bulentine and E.
E. Drlacoll had finished their
closing argumenta before the
Jury at noon.
Testifying for himself today,
Gartin said that the girl had
come from Chemawa, where
ahe is a student at the Indian
school, with him and Bob Far
ris early In April, but said that
ahe told them ahe was going to
California. He admitted he had
given her money for a room,
but denied that he had been In
timate with her.
On April 21, Easter Sunday,
the duy the 13-year-old told the
Jury thut he had vlaitcd her in
her room at a Klamath avenue
rooming house, Gartin said that
he had spent the day in Chilo
quin and waa not in Klamath
Fulls at all. His wife, Virginia,
alao testified that he had been
in Chiloquin that day.
The attractive girl, an eighth
grade atudent at Chemawa and
rcaldent of Pendleton, aaid yes
terday that Gartin hud given
her the money to rent the room,
$1 a day, and that he had visit
ed her on several occasions.
