A Statement
This statement is prepared and submitted for publi
cation by a committee of lawyers acting on behalf of a
substantial majority of the practicing lawyers in Klam
ath County, for the purpose of rebutting and explaining
the certain discussions and articles which have caused
the public to question the integrity of the Klamath
County Bar and the Court procedure which is followed in
this county. v
Under our system of legal procedure it is the duty of tho presiding judge In every
case, both civil and criminal, to dismiss the proceeding if the complaint or indictment is
fatally dofective. The failure to follow this procedure by the presiding judge would re
sult in a miscarriage of justice with subsequent appeals to the supreme court at the
expense of the taxpayers and the interested parties.
Recently there has been some discussion as to criminal cases being dismissed. THIS
COMMITTEE DESIRES TO INFORM THE PUBLIC THAT DURING THE PERIOD IN
WHICH THREE CRIMINAL CASES HAVE BEEN DISMISSED ON THE APPLICATION
OF THE DEFENSE AND OVER THE PROTEST OF THE DISTRICT ATTORNEY THERE
HAVE BEEN THIRTEEN CRIMINAL CASES DISMISSED ON THE APPLICATION OF
THE DISTRICT ATTORNEY.
IT IS THE OPINION OF THIS COMMITTEE AND OF THE LAWYERS OF KLAM
ATH COUNTY REPRESENTED BY THE COMMITTEE, THAT COURT PROCEDURE OF
THIS COUNTY COMPARES FAVORABLY WITH THAT OF, ANY COUNTY OF THE
STATE; THAT CASES FILED HERE, BOTH CIVIL AND CRIMINAL, ARE DISPOSED OF
PROPERLY, EXPEDITIOUSLY AND ACCORDING TO LAW. THAT CRIMINAL CASES
ARE FAIRLY AND ADEQUATELY TRIED AND ARE DISPOSED OF AS EXPEDITIOUSLY
AND IMPARTIALLY AS IN ANY OTHER COUNTY OF THE STATE.
