FRIDAY, SEPTEMBER 14, 1923 Misguided Leniency PURPOSE OF ARRESTS, convictions and sentences is twofold; one, as just punishment of one who has transgressed on rules of conduct set by society; and two, aa a deterrent to other potential law violators. Of all classes of criminal acts, that of arson is per haps the most cowardly. There is not even the saving trace of misdirected personal courage in this offense, such as there might be in other types of law violations. Roseburg is some distance from Klamath and there might be extenuating circumstances in a case there to day, of which we are not familiar. However the facts as reported in a press dispatch are as follows: Between 50 and 75 fires were set within several days in heavy stands of timber in Douglas county; after exhaustive in vestigation, authorities arrested a sheep raiser on the ! charge of arson; this wool grower today entered a plea of guilty to the charge; he was charged only with mis-1 demeanor, fined $200 and released. I Frankly, we believe the penalty this sheep raiser paid 1 failed in both purposes of public prosecution. It failed ' to punish the offender severely enough and it certainly .set no example that would frighten others who might follow the same course. ' 1 The fact that the fires were extinguished before ma terial damage was caused, that the farmer, perhaps, had ; a family, and that others would have suffered by his in carceration, is entirely beside the point. The fact of the ; matter is, that millions of dollars was threatened, homes and lives endangered and a county's wealth was in ' jeopardy by the cool, calculated act of an arsonist whose j only explanation was that he wanted more range for his i sheep. i Here was an opportunity to set an example for forest i fire arsonists and what happened? A mere ?200 fine. ! ! We sincerely hope that hunters, particularly those seeking pheasant and quail, will respect the rights of Klamath basin ranchers. Fenced land means simply that true sportsmen should accord the land owner the courtesy of asking permission to hunt. ' Nine times out of 10, the land owner will be glad to allow hunting. He might take the name of the hunter and license number of his car to protect himself in event of property damage, but, subject to these possible re strictions, he will usually be glad to allow hunters on his land. If he refuses, that's his unchallenged privilege, and the nimrod should certainly refrain from violating his order. There is one rule to follow, a very sensible rule that will make for better feeling between land holder and hunter It is the age-old Golden Rule: "Do to others you would be done by."
