In tbe case of tbe State vs. M. J.
Reugan, charged wltb larceny from
a dwelling. W. P. Myers, attorney
for Iteagan, pointed out to the
court that bis client had been In
carcerated for 177 days awaiting
trial and that the articles stolen

not over 1 1 G In cost. Myers said
his client 'would1 appear and enter
a plea ot guilty' to a charge of
petit larceny and asked tho court
for leniency in sentence under

For First Time

Long overdue, the first official
dairy rating of Klamath dairies
under 'the new system 'introduced
here by Dr. E. D. Lamb, deputy
state dairy food commissioner, was
annuuueed last Saturday night.
Tbe report practically revolution
ise dairy ratings In this county in
that a dairy Is officially rated on
its milk, ratiior than on Its equip
ment. In the past dairy rating scores
published for tbe benefit ot the
I consumers were baaed entlrelr no
on equipment. An inspector sur
veyed each dairy each month and
checked up on tbe equipment at
hand, tho cleanliness of tbe barn,
but did not test tho milk.
Milk Counts Now
Now, the conveiso is truo. It is
only tbe milk that counts. Milk
samples from each dairy wero
picked Indiscriminately and sent
nortb to tbe state dairy and food
commission in Salem, where they
were tested for bacteria count, flav
or,, odor, butter fat, sediment con
tent, bottlo and cap.
Klumath Tails creamery la at the
head ot thu list and tbe only class
A creamery In tbe county. Moun
tain dairy is second and Lost River
third.

Another automobUe aecident fatality, the fourth tn Klamath
during the past three weeks, occurred yesterday when C. T.
Boynton, 2020 north Second street, aged 66, lost control of
his car at the foot of East street, near the Eleventh street canal
bridge, plunged into the main canal of the Klamath Irrigation
district and was drowned. ''"
The tragedy took place yesterday afternoon about 1:30.
The body was not found until shortly before 5:00 o'clock. Boyn
ton was employed in the box factory of the Pelican Bay Lumber

Boynton, coming down the steep hill on East street, appar
entlv lost control of his light, cheap open car. At the foot of
East street is the main irrigation canal from five to seven feet
deep. Connecting at the foot of East street is a narrow and
dangerous road which parallels the canaL

attempted to make the sharp right
hand turn from the foot of East
street Into the narrow lane along
tbe canal.' The light car failed to
negotiate tba ctirve and turned over,
rolling down the bank Into - the
canal. . '. ,
Boynton waa thrown ont as the
car started to roll over. The ma
chine rolled over on top of him In
its downward drop into the canal,
crushing his ribs over the heart.
The car - struck the water first,
landing upright on four wheels.
Boynton, unconscious, fell In Im
mediately afterward and Imme
diately sank. 'I
Two Witness Accldent-
A. E. Ltndsey, residing on Elev
enth street, and Dick Ray saw the
accident. They rushed to the canal
bank In time to see Boynton sev
eral feet under water, floating down
stream. . He had one arm over his
face, as if trying to shield himself.
Ray waded into the swift current
up to his shoulders and reached for
the body. It sank suddenly. Just
out ot his reach.
' Police Toko Chargo "
A few minutes after the tragedy,
Chief of Pollco Harry Loucks and
Pollco ratrolmen C. F. Morgan and
Itoss 11. Brown arrived and 'took
charge ot the search. The officers
obtained a boat with a "kicker"
from Alex Stevens, local garage
man.

Portland, with grappling hooks, lo-

Examination of tho body by tho
county coronor immediately follow
ing tho accident revealed that Boyn
ton had Incurred probable fatal In
juries when tho car rolled over on
top ot him. Ribs over his hourt
wero crushed in, apparently .by the
top ot the front seat, as the car
turned over.

grandchild had been located and was
oxpeclud to arrive In this city this
