Owen, who was extradited (rom l.'tah (or trial In the case, must both be sent to the Oregon peni tentiary to serve up to 3 years (or aiding VV, H. Johnson to detraud tho bank of Jacksonville In 1919 This Is tho ruling of the state su preme court today in the cases of against Owen, affirming the lower the state against Kubil and state court for Jackson county where the cases were tried before Judge F. M. Calkins. Justice Burnett wrote the supreme court opinions. For bis part in tho crime Johnson at the state penitentiary April , 10, cashier of the bank,, was received 1921, to serve up to 10 years. On February 14, 1924, his sentence was commuted by Governor Pierce to seven years nnd on May 20, 1924, he was paroled. The state does not attempt to pass on tho question whether or not t Is a crime to overdraw a bank ac count. .. "The thing forbidden In the statute," says the opinion In the Kubli case, "is the misapplication of the money, funds, credits, assets. or property ot the bank with the In tent to injure or defraud the bank. The check on which Kubli was In dicted was for $50, but It is shown in the opinion that his overdrafts at the time amounted to about $40. 000. The check on which Owen was indicted was for $100, but testi mony showed that nt the time Owen owed tho bank about $20,000, main ly on overdrafts.
