MORE LAW DEFIANCE
Pending before the eitv council is an ordinance that
has for its purpose the vacating of certain streets in I
the vicinity of the city hall. The object of the vacation j
i.i to turn the property over to the Big Lakes Box com-
pany and the Klamath Falls Heating company. Oppos- i
.d to the move are many of the residents in the neighbor-!
hood.
The sentiment of the council is for closing the streets.
This is not surprising, for ever since the present council
took office it has pursued a policy of open defiance of
law in favoring the closing of these streets it is just
running true to form.
Under the law the city council has not power to close
these streets. It is immaterial that the city charter has
a provision under which the council may claim auth
ority to act. The state law says that the council cannot
do what it is planning on doing. So, also, does the
:;tate constitution. But, as a more or less noted congress
man once remarked, "what is a little thing like the con
stitution between friends," and this seems to be a deal
between friends a deal whereby city streets are to be
closed and turned over to private interests.
Fortunately for the people there is a man occupying
the office of mayor who has shown that he is watchful
of the people's interests. He has prevented more than
one grab, and it is not unlikely that he will prevent this
latest one. When Mayor Goddard leams that the coun
cil has exceeded its authority, that it is surrendering
public property for private use and. benefit, it is not
likely that he will approve such an ordinance.
KILL IT
The city council should not hesitate to kill the reso
lution which the mayor has vetoed, granting to the
Strahom line the right to cross Sixth street. It should
be the policy of the city council to grant no such right
to any railroad unless coupled with it is the common
user provision. The people of Klamath Falls are over
whelmingly opposed to any railroad bottling up this
city, and it comes with very poor grace on the part of
Mr. Strahom to ask for the sixth street crossing fran
chise without the common user condition, when the very
thing that made his road possible was the belief on the
part of the people that it would furnish common user
advantages for any railroad that might desire to enter
this city.
If the council adopts the crossing resolution it will
mean that each member will face a recall.
