"A FRIEND INDEED"
We are told that W. P. Myers, acting district attorney,
is proving to be a tried and true friend in coining with
out pay so we are told to the defense of A. A. Anness,
who is now on trial in federal court on a charge so re
volting that even the public is barred from hearing the
salacious testimony. ,
!- A tried and true friend to whom? To the public whom
' he is supposed to represent as acting district attorney of
Klamath county? Most assuredly not. . . . . ,
A true friend of decency, of law and order? Is It not
a vile insult to the motherhood of Oregon? ' . "
A true friend to Anness, whose reputed conduct with
a 12-year-old girl was so revolting that the federal gov
ernment was forced to Step in and insist upon prosecu
tion when the state courts failed to bring the creature
to justice? .; J" yi - -
There we have it. We are willing to concede that
the acting district attorney of Klamath county is a "friend
indeed" to this man Anness, who is alleged to have flitted
about the country with a 12-year-old girl as his consort.'
But what of the public, which pays the acting district
attorney ajnonthly salary on the theory mark well the
word that he shall be the guardian of law and order in
i. Klamath county? What of the oath of office which the
acting district attorney took when he entered upon his
duties?, . , y !-?. " y'" .
: Aside from the ethical features of the case, which pre
sent the spectacle of a prosecuting attorney. defending a
man charged .with a most heinous crime, the rights of the
t' public; of law and oMeY and decency, are paramount to
, the rights of this man Anness and. his attorney. , .'
, The guilt or innocence of Anness is beside the question!.
The fact remains that the acting district attorney has no
btv-iness neglecting his public work to defend a private
client in the criminal court of the United States.
It is unfortunate that District Attorney Ganong is in-
capacitated and unable to attend to his duties as prose
cuting attorney. But for his. own. sake and for the sake
; of the Klamath-public, which really suffers the most,
District Attorney Ganong should rid himself of the man
Myers. ' ;.

the processes ot the law become so
involved that the government itself
cannot follow them, it would Seem
to the laman that the time bad
come for some simplified and com
monsenBe rules of procedure.
Contempt tor the : IaV, about
which public authorities complain
so bitterly, is helped, not hindered,
by the spectacle, of such -denouements
as came In the government's
prosecution of criminal indictments
again Fall, Sinclair and Doheny In
scandal."
The Indictments were quashed
by Chief Justice McCoy 'of -the Dis
trict Supreme COUrt, hot because
cf any question of fact in the evi
dence submitted to the grand Jury,
but because of the presence at the
grand Jury hearing of a representa
tive of the Department ot Justice.
The only possible conclusion is
that the, Department : of Justice it
self cannot tell, under, the Involved
and Intricate technlcaliles that have
coma to surround grand tiury' pro
cedure, when it should and when
it should not take a hand in pre
senting evidence , 'for' prosecution.
Any other 'conclusion would mean
that the department deliberately
acted in a way to Jeopardize the
validity of the indictments; that
the department ' was directly seek
ing to thwaru,not to obtain Justice.

cidents were based. If on appeal,
the action of Justice McCoy is sus
tained, the government will, by the
action Of one of its assistant attor
ney generals, have lost the right to
press these bribery charges further.
The whole cause of Justice, there
fore, rests not on the fact ot brib
ery . or lack of it; but on a tech
nicality which bars the way to any
trial on . the real facts. And In
this case the government itself set
.up the technicality which thwarted
its own prosecution.
