Order and Notice'
In the matter of establishment of
Toll Road on Klamath Falls, Bend
County Road.
It appearing to the Court at this
time that the oM counbr road from
the Intersection with the State High
way at the gap on Fort Klamath
Hill : In Klamath County to the
county line north ot Crescent, Ore
gon, Is little osed for local travel;
and that there are very few residents
on said described road; that it Is
so located that -there la little or no
local labor along- the line of said
road, and that for '. the county . to
maintain said road In a- passable
condition would entail a' very heavy
expense, far out 61' proportion to
the benefits to be derived; arid that
each ' year during the period of
from about the first Jay of Decera-
Hber to about theflrst o June said

Is ordinarily abandoned.- during the
greater portion ot said, time-by the
traveling public owing to tbe' diffi
culty of passing through the' heavy
snows In the winter ime; and that

with the State, constructing a new

tioned, and the county does: not de
sire to divert money from, said high
way construction for the purpose of
maintaining a road that will shortly
bo abandoned almost wholly ty the
public; and that there is sow little
or no local labor along saW old
county road; and It appearing ex
pedient and lawful that a toll., road
should be established on said old
county road, and tho Court being
now fully advised in 'the premises.
It -Is, horeby ordered that said
road, between .tho termihl - above
mentioned be leased to any person
or corporation .to open, improve and
koep same in repair' for-the period
ot ttve years between December first
and June first inclusive Only, with
the right in consideration there to
collect, and receive-tolls fop: travel
thoreon as provided ' by Chapter
XXXLX, Title XXX, Oregon. Laws;
that four gates shall be placed on
said road; that tbe grade ot ' enld
road shall remain as now establish
ed; that tbe materials for construc
tion of said road shall be as now
used therein; and It is further ordered-
