ot Klamath, by Us duly authorised

part, and H. F. Vlcory, party of the
seconJ part.
Wltnesscth, first party has here
tofore, on the 27th day ot Septem
ber, 1924, accepted the bid , ot
I second party for the (grading of
approximately five miles of the
Market Road from CMIoquIu to the
Dalles-California Highway, about one
mile north of the Williamson River
bridge. In Klamath County, Oregon,
said road being designated as the
Chilouuin-Wllllamson River Market
road; and
Whereas, the "Advertisement, specifications-
and form ot proposal,"
together with such bid ,mnde by
second party and accepted by first
party are now on file with the
County Clerk ot Klamath County,
Oregon specifying the work .to be
done, and In detail specifying the
manner ot performance thereof,
which said work Includes clearing,
grading, excavating, and the plac
ing ot drainage culverts;
Now therefore, in consideration ot
the covenants of the respective par
ties hereto it is hereby
-Mutually Agreed, that second par
ty . will clear, grade, excavato and
place drainage culverta In said five
miles of the Cblloquln-WUllnmson
River Market road; that he will per
form' said wark strictly In accord
ance with said advertisement, spe
cifications and form ot proposal on
tile in the office ot the county clerk
of Klamath County, and that he will
complete said work within one hun
dred working days from said 27th
day ot September, 1924. It is fur
ther Mutually Agreed, that said adver
tisement, specifications and form of
propiSiil be and they are t.oreby
made a part ot this agreement, ami
that the authority ot the engineer,
the estimates and partial payments',
final payments, and all other details
touching the carrying out ot the
purposes, set forth therein, shall
govern by the provisions of said
specifications.
. Jt is further agreed, that sacond
party shall execute a good and suf
ficient bond In the sum of one-half
of the estimated 'total amount ol
the contract price, as specified In
said bid. for the performance of
said work. '
The respective prices for perform
ing the work hereinabove specified
shall be. as follows:, --.

2. Common excavation and grad
ing, 25,000. cubic yards 23c.
2. Rook excavation, 300 cubic

$1000.00 cash bond here-tofore fur
nished by Harris and Loe for the
clearing of 25 miles of - Dalles-Cal
ifornia Highway, and substituting a
personal bond in lieu thereof. -
This matter coming on-at this
time upon application of Loe and
Harris tor a release of the $1000,
cash bond heretofore furnished tor
the clearing of 25 miles of. the Dalles-California
Highway,, and asking
the court that a personal bond in
the . sum of One Thousand Dollars
be substituted for jald cash bond
and It appearing to' the court that
said personal bond has' tbl3 day
been filed and that George Loe has
signed said bond as principal and
Marlon Nine and Preston .Nine as
sureties, and all things appearing
regular. .. ...
. It Is hereby ordered by the court
that the said personal bond be. and
the same Is hereby approved and
accepted, and that the County Clerk
